Huge chunks of Alabama's misguided immigration law already have been put on hold by federal courts, which means those provisions aren't likely to be upheld as they make their way through the system.
In the end, the whole law, save the E-Verify portion, may get tossed, as it'll be difficult for the U.S. Supreme Court to justify allowing 50 separate immigration laws in an area that is clearly the purview of the federal government. Immigration issues affect more than just state and local governments; they affect U.S. foreign policy and relations, a responsibility strictly reserved to the federal government ...
Strange said lawmakers should eject the part of the law that requires schools to keep data on their students' and parents' immigration status. That part of the law has been put on hold by the federal courts. Strange also wants the Legislature to repeal the section that allows private lawsuits against public officials to compel them to enforce the law. Being the bully on immigration isn't working. Maybe it's time to try being more sensible.
