Utah Bill To Ban Gay Marriage Withdrawn

A bill that would toughen Utah's prohibition on same-sex marriage has been sent back to the drawing board after legal experts declared parts of it to be unconstitutional.

The former chief justice of the Utah Supreme Court, two law professors from Brigham Young University, and lawyers for the ACLU said the bill was poorly crafted and might result in legal challenges in which the legislation would fail.

The biggest problem was a section of the bill that would bar same-sex couples who marry or enter into civil unions elsewhere from going to court in Utah to resolve questions on matters ranging from child custody to inheritance rights and insurance benefits.

5. I'm guessing this issue has far less to do with phony christian morality

than it has to do with insurers not wanting to pay claims.
I was always opposed to marriage (legal marriage, I mean, a religious, personal or social agreement/celebration was fine with me) because it always seemed like an unnecessary government intrusion into a private affair. I still feel that way, but I married in order to be able to insure my partner because the profession he had chosen was unstable and prone to lay-offs.

I think marriage should be a personal matter and the government really should have as little as possible to do with it. As far as insurance goes, wouldn't it be nice if the concept of family were expanded to include longtime roommates of people who never got married and weren't even in any kind of sexual relationship? It would be refreshing to see people interested in building stable households and not being so hung up on what goes on in other people's bedrooms.

works like that...if two people live together for more than 2 years
they can file to become legal domestic partners, with all the rights
of a spouse.
It was originally designed for gay couples and elderly companions but
it could work between two long time roommates, the states doesn't really
care what your relationship is

A law like that is great for people in various situations, as you pointed out. I think more Americans should be made aware of just how many people would benefit from such a law. Many automatically associate domestic partnerships with gay marriage and therefore, unfortunately, are hostile to it. If it could be shown to the public that straight people also have something to gain by passing domestic partnership laws, they might be more reluctant to pass that amendment. It's a shame to be forced to appeal to people's self-interest rather than their charity, but I've found that self-interest is usually a stronger motivator.
