Demands For Newsom's Arrest Grow

(San Francisco, California) A second conservative group is demanding the arrest of San Francisco mayor Gavin Newsom.

"If New York State can charge a little mayor with violating state law, then California's attorney general should have no problem charging a corrupt mayor of a big city with violating the law," said Randy Thomasson, executive director of the Campaign for California Families.

The renewed call for the mayor's arrest followed charges against New Paltz, New York mayor Jason West. As reported Wednesday by 365Gay.com West pleaded not guilty to 19 charges of violating New York state law when he married more than 20 same-sex couples in the small village. (story)

Last week, the American Family Association Center for Law and Policy, a rightwing legal group which is representing conservatives in the ongoing anti-marriage court battles said Newsom's decision to allow same-sex couples to marry "not only violated civil law, but also criminal law" and called for the mayor's arrest. The sooner they do, the sooner we can get it in the courts. And, after all, isn't that really the purpose of civil disobedience?

...put it through the courts as a separate case.

What we need is for the couples who have gotten married to sue the state for recognition of their marriages. Once they do that and win, then they can sue the federal government to get recognition for their marriages nation wide as well.

6. It is not unlike the Moore/Ten Commandment thing
I know this is playing devil's advocate, and I was about to write a post saying how nuts these people were -- I mean who gives a rats ass if two people want to get married --

then I realized that it has parallels to the case in (was it Mississippi?) where Roy Moore insisted on having a stupid block of rock with some bible quotes on it.

Go ahead, flame me, I took a vicodin already tonight. :)

I am also not up to par on all the legal issues surrounding this. This is just a thought that occurred to me in my current blissful state.

But the big difference between the two cases is that Judge Moore was ordered -- repeatedly, by several different courts -- to remove the 10 Commandments monument. In each case he refused to obey the court order, and in the end it cost him his job.

Court cases over the same-sex marriages in San Francisco have been presented to two lower court judges, and to the California Supreme Court. None of those three courts have ordered Mayor Newsom to stop the marriages. I believe Mayor Newsom has said that if he is ordered to stop, he will.
