just heard scalia recused himself from the "under god" debate in the Supreme Court,but won't recuse from cheney energy debacle.Does anybody have any input we're open to discussion.:wtf:

The pledge is just a social issue with no big money players involved in the game. If there were, you know which side Scalia would be on.

11. He had already spoken about ...
the case publicly and said that the Appeals Court ruling was wrong. He recused himself because he he had prejudged the case.

12. He's already spoken about the case.
He isn't supposed to "pre-judge" a case he is going to hear but he spoke on the issue (clearly) just a few months ago.

...to keep the "under God" in there, and if it's taken out then the Reich-Wing would have an excellent theme to run on to avoid Iraq/the economy/and now, the war on terra since the Clarke book.

7. Somewhat "old news" potentially "BAD news".
It's unlikely that he would have been the deciding vote on the issue. I expect the ruling will be overturned 6-2 and he would just make it 7-2.

If (as some have expected) his recusal causes a 4-4 split in the vote then the original ruling would stand (until a future court takes it up) and Bush would have a ready-made flag-waving in-God-we-trust wrapped-up-in-a-pretty-bow issue to run with in November. He wouldn't lose a single vote for coming down on "god's side" and either way Kerry falls he'll bust up some of his base.

This could be VERY VERY bad. Some have even speculated it was WHY Scalia chose to recuse himself - to set up this very possibility. if he was so "ethical" on the recusal issue there are a couple other cases he would have dropped faster.

Bush would LOVE one more excuse to hammer "activist judges"

But as I said, I doubt it will come down to that.

Kerry and other Dems wouldn't let bush just walk away with the flag. That charade is over. Besides, the footage of Kerry in Nam with a flag superimposed would deliver a message bush never could. Kerry didn't just pay lip service to the flag, he put his live on the line for it.

And the base is unified except for the naderites (who'll come around before its too late, imho). ABB will only gain momentum.

That might be the plan, for this case to be the "God and country" issue for the traitorous regime, but it will fall flat if we challenge it.

This assumes Kerry would come down on the side of keeping God in the pledge. If he came down on the side of removing it, we're done.

15. I think you are missing the point.
Service in Nam is not the issue here. If a Supreme Court ruling comes down taking "God" out of the pledge there will be a nationwide reaction. Both candidates will be forced to take positions (and "I voted for it before I voted against it" isn't going to play very well). Are you in favor of an ammendment to allow "God" in public life? Or shall we take out "In God we trust" from our currency?

If Kerry says he supports the decision he'll lose 49 states. Kerry HAS to come out in favor of "God" and STRONGLY. This WILL cause a problem with the base. Plenty of people here on DU would cease supporting (ABB or no ABB) someone who did that and Nader & the Green nominee won't be making the same call.

This would be BIG. FAR bigger than Kerry's current problem with "gay marriage".

and I agree that it is a remote possibility that the court will split (although they are the same gang that put bush in office in the first place).

and I agree that a "for it before I was against it" um, slip or whatever that was, would be deadly. He would have no choice but to strongly support keeping the pledge as is.

if the court does split, and Kerry comes down forcefully on the side of keeping the pledge, I just don't agree that the base would fracture. I might be wrong, wouldn't be the first time for that either, but I just don't see our guys flocking to nader or staying home over it. There are bigger threats to our nation right now (the bush gang, not aq) and I think more and more people are realizing that.

scalia recused himself from the pledge case a few months ago after making some disparaging comments about it merits in public. As for the Cheney case, no he wont step aside and there is a damn thing we can do about it. I'm so fing sick of republicans i could scream.

17. Scalia made public speech at some convention supporting "under god"
in the pledge a year or two ago...i don't think he has made any public statements regarding the cheneys energy task force :shrug:
but in my opion just the fact the he ruled in favor of bush in bush v gore should be enough for reason to recuse!

again, BUT, hey what the fuck do i know :shrug:
