Judge Dismisses Two Nichols Jurors

McALESTER, Okla. - Two members of the jury considering sentencing for Oklahoma City bombing conspirator Terry Nichols were dismissed by the judge Wednesday and were replaced by the last two remaining alternate jurors.

Judge Steven Taylor did not explain what the two jurors did wrong, but he strongly told the rest of the panel not to discuss the case outside of regular jury deliberations.

"Do not discuss sentencing," Taylor said following a one-hour closed meeting with prosecution and defense attorneys. "Do not allow anyone to discuss it with you."

One of the jurors dismissed Wednesday was the jury foreman.

1. What happens if there's a mistrial in the sentencing phase?
They would just have to lose one more juror for that to happen.

...happened with those two jurors. I'm sure the jurors are under one heck of a lot of pressure; I wouldn't want to be one.

3. According to one of the talking heads, the sentencing phase
would then be left up to the judge to decide, not the jury.

8. Unconstitutional
The Supreme Court said that wasn't acceptable, has to be a jury. I'd think there'd be a mistrial and new trial.

what ever happened to the 11 security camera's that caught everything but were confiscated by the FBI and not allowed to be shown at the trials?

5. I think the FBI lists 23 tapes in evidence; the Secret Service log...
...discusses one of them. I think it is from the camera on the SW Bell building. I don't know why the official position is that there are no tapes when two different services talk about them.

9. Well, here's the thing:
This actually doesn't have anything to do with the jury members being dismissed, but, if the death penalty is in effect in OK, and Nichols has been convicted, why would they NOT give him the death penalty? If killing 169 people doesn't get you a lethal injection, what would? This seems like it should be a slam dunk, I'm wondering why the jury is out for more than an hour deciding this. Anyone know?

10. The Jury must have had some concerns about the evidence...
...is all I can figure. A lot of the government's case had a bad smell to it.

13. Videos of explosion - Any lawyers here who know why the...
...government wasn't forced to produce the videos that the FBI lists in inventory and the Secret Service references?

If the government can just say there are no tapes and it is let go at that...why didn't Nixon just destroy his tape? :)
