Limbo Sez HE Asked Marta for the Divorce

No link. In his opening today, he said that all he was going to say about the divorce was a "clarification that Marta asked for," which was that HE is who asked for the divorce. What a gentleman. Let's see, HE is a self-centered junkie and HE asked for the divorce. Well, alrighty then.

Red Rover, Red Rover, let -----MARTA-------come over. For sure there's a pre-nup, and an ironclad confidentiality agreement---------but betcha she would make A HELL OF A LOT MORE with a tell-all than with a settlement. Marta, can you HEAR me????

1. Does that mean she will be able to testify against him if there is a trial
I know that normally spouses are protected but now that they are getting a divorce...can she testify that he engaged in doctor shopping?

She couldn't be compelled to testify, but, I do believe she can do so with free choice.

11. Interesting. Most prenups have a "10 year" clause.
If the marriage lasts 10 years, the one without the $ (the reason for the prenup) usually gets a much bigger chunk-o-change in a divorce settlement. And... if he actually wanted the divorce (even though we've been hearing that she had moved out of the big house long ago), she'd get even more $.

I don't believe a word Rushbo says. To men like Rushbo, divorce is the way they pay for sex.

It cheapens marriage if anyone can just run out and get a no-fault divorce. If Reagan hadn't signed the nation's first no-fault divorce law, maybe 1/2 of all marriages wouldn't be ending in divorce today.

and they shouldn't be forced to endure a lifetime of Hell because of a no divorce statute on the books. What happens usually, in no divorce countries, is that bigamous relationships become more numerous. As couples break up and seek another, they often don't tell a new amor that they are already married. I know. It happened in my family.

We have it backwards. We make marriage easy and divorce hard. It should be the other way around with marriage requiring a reasonably long engagement with marriage classes and conseling leading up to the nuptials. Divorce should be easy and relatively pain free on the other hand.

27. Spousal privilege
That they are splitsville now doesn't matter -- she can't testify as to anything he told her during the marriage. The privilege is Limpball's -- no one can waive it except HIM (i.e., the one against whom the privileged testimony would be offered).

Note that the privilege applies only to spousal commmunications. If she was an eye-witness to something, she **might** be able to testify over Limpball's objection. But the water startes getting murky there, and many judges would just disallow the testimony. Where it clears up, of course, is if she actually DID anything illegal, e.g., procuring Oxy from several doctors for her hubby.

That's the general rule on spousal privilege -- individual states may differ.

Not because of any confidentiality agreement in the divorce, but because of the spousal privilege. And she stands to gain nothing from testifying.

Now, as for writing a book -- "Limpballs and Me" -- that's another matter.
