I am sworn to uphold and defend the Constitution
no, really, I am. I was reminded of this at a (re)confirmation ceremony for members of state boards and commissions; mine is relatively minor, but we still got to go to the former governor's residence (and take the oath).

How, then, should I best discharge my sworn duty? I'm thinking about something related to the Patriot* Act, but what, exactly?

3. Well, according to the Constitution
It's the highest law of the land, co-equal with all treaties the U.S. is signatory to (Article VIII, I think). On reliable testimony by the perpetrator himself, you have it on good authroity that the resident at 1600 Pennsylvania Avenue is in violation of the Geneva Conventions, a duly executed treaty to which the United States is a signator.

What are you waiting for?! Get off your ass and defend the Constitution, KamaAina!

5. It's Article VI
Article VIII is the one that gives Bush* authority over the United States; in other words, it does not exist.

What course of action, precisely, would you propose against the pResident? A citizen's arrest? I could even consult with Jim Nabors, a long-time Hawai'i resident, on just how to say "Citizen's array-est! Citizen's array-est!" like I mean it...

4. I swore to uphold and defend the Constitution when I was drafted
and I swore to uphold and defend the State of California's Constitution when I volunteered to work for the State Park system.

So I think it is my duty to uphold and defend gay marriage because neither constitution forbids it.
