She's the woman that Drudge falsely accused of having an affair with John Kerry.

She's not a public figure like Sidney Blumenthal was, so she may not have to prove actual malice.

She could wait until after the election, so as not to draw undue attention. The statute of limitations is one year. It happened in February, 2004.

He has a million dollar income and is not judgment proof.
