Betcha', betcha'
that the Federal judge reviewing the ACLU petition to move the CA recall election to March will rule in FAVOR of the petition. Why??--'cause two powerful political forces will make him do so. .. (and don't tell me that judges are above that--that went down the drain when those judicial political hacks on the Supreme Court gave us Bush). Take a look at the two forces:

The Dems want the time to convince the CA voters that they are under attack by the GOP and will be the next Florida; time to spruce up Bustamante (sp.?)--perhaps even re-event Gray Davis. They cannot do all this in a few weeks. But then look at the repuke side:

Arnold is not the choice of the Bush Gestapo. They engineered the CA recall (you can bet they did)and assumed they could put in one of their handpicked henchmen with only a few percentage of the votes, due to the different format of such an election. Arnold has fucked that up. They need time to destroy Arnold.

They will pull what they did to McCain again---i.e., calling people and smearing him. With McCain, they admitted it was unfortunately "over zealous backers" and would discipline them (yep, right..it's Papa's favorite means of campaigning). This time they will bring up everything from Arnold's Nazi dad to his sex rompings, steriods, etc; but will deny that repukes could be attacking repukes. They will blame it on the Dems. They need the time to do their work and to pour money into their henchman's campaign. They need time for the Arnold "political buzz" of the moment to grow stale.

None of the power big boys now want this election to happen in October---so whichever side controls this judge, will make a call, reach out and say "hi, buddy...got a favor to ask of you..."

1. Don't know that this particular judge is necessarily the one
that would do that. He has a reputation even when he wasn't on the fed bench as a pretty straight shooter. I would venture to guess there will be attacks on him no matter the case but he is pretty fairminded in his approach.

Per our phone in lawyer Monterrey County Bar guy says that he is "annoyed" by the amicus briefs coming in from the rightwing--- lottsa "States rights" crap not pertinent---- and according to our guy, is one hell of a stickler when it comes to the Federal Voting law, which he has already stated Monbterrey County would be in violation of.

Dangling participle aside, the guy is a straight arrow and the very cogent case presented by the ACLU on this issue looks damn strong to THIS partisan. Best hope besides the "ballot too freaking big/ postage /unfair to low income mail in voters" tack.

2. I don't think it should be delayed....
Californians have this silly law on the books. I'm afraid they'll have to reap the whirlwind. I do admire Bill Clinton for trying to campaign for Davis. It shouldn't be so easy to "un-elect" a governor, and I think it's bad for democracy and the consistency needed in government policy to have unplanned interruptions in service.

But, the law (however imperfect) was followed, and people will have to get off their lazy asses and go vote if they want to keep Davis.

3. The petition that's been filed
concerns civil rights voting issues. CA is still part of the union that guarantees those rights.

here are not happy campers, that's for sure. Ah-nold got all the media hype but after one week Bustamante is leading him in the polls. So even electing the RINO is problematic at this point.

It's pretty amazing reading the articles about Arnold that are filling the newspapers - so much on his drug usage, womanizing, coarse language, etc. He's definitely not what Issa had in mind when he started this (propably with the help of Rove, too.) Yeah, Ah-nold is getting plenty of media attention but hardly the kind conservatives like. They do seem to like McClintock but he is polling at about 8% and it will take a miracle (or a court order) to change that around. Simon is just an idiot and won't get the backing of the big boys. He failed them last time and they do not like failure.

Maybe they thought they had a sure winner with Ah-nold. Maybe they thought they could control him and it's not playing out that way. Who knows? But one thing for sure, the conservatives do not like Ah-nold and could sure use some added time to make Mr. McClintock into someone more than 8% of the people would vote for.

Of course with the Blackouts showing us all that this ccould happen to anyone, not just Davis and CA, this could shed a different perspective on it as well.

10. indict---agreed!!! The first I laid eyes on this bastard
was in campaign 2000 where he was in charge of one of those "groups" that whichever network followed to see what their thoughts were on the debates, etc. This fucker absolutely manipulated this crowd and then would end his segment with the great pronouncements of how they were all swinging to Bush. By the end, he had like all but one of them, saying they would vote for Bush. It was beyond disgust. And it is disgusting to see Matthews bring this asshole on as the only pollster he talks to as if this slime is giving him the straight shit.

was the phrase Luntz used to describe the Recall campaign against Davis. Make it seem like they feel really really bad about having to do this... They did it with glee.

I think your analysis is correct. The conservatives are not happy right now. Ahnold is not playing so well. I'm feeling more optimistic about the recall. I think a huge problem will be making sure dem voters know that even if they oppose the recall they have to vote for Bustamante.
