Tinfoil Alert: Text of VICTORY Act Leaks

Measures in the 89-page draft include:

• Creation of a new category of crime called "Narco-terrorism."

• Radical expansion of asset forfeiture powers for the Departments of Justice and Homeland Security.

• Expansion of the definition of money-laundering to several kinds of transactions, including offshore banking as a means of tax evasion.

• Creation of a ludicrous new "crime" of "reverse money-laundering."

• Longer jail terms for a number of nonviolent drug and nondrug offenses.

• Expanded opportunities for judge-shopping in wiretap cases.

•Expansion of nonjudicial "administrative subpoenas" for "terrorism" investigations as broadly defined in the USA PATRIOT Act.

1. That bill looks genuine to me...
I couldn't find it on THOMAS, but everything about that bill looks like a real one...right down to the S.L.C. (Senate Legislative Counsel) marking.

5. Just remind your Republican friends...
...of how that clause could be used under a Democratic administration (say Hillary, she always scares them) to prosecute Bush supporters like Ken Lay for terrorism...that'd be a hoot...

Terrifying. This is just part of the new product rollout for September imho. And in light of the strong pushback against the original Patriot Act on both the left and the right, the fact that they're pimping makes my hair stand on end. Is this the runup to LIHOP Part 2?

Edited to add this snippet from the proposed Act.

SEC. 2. SEVERABILITY CLAUSE. 1
If any provision of this Act,an amendment made by 2
this Act,or the application of such provision or amend-3
ment to any person or circumstance is held to be unconsti-4
tutional,the remainder of this Act,the amendments made 5
by this Act,and the application of the provisions of such 6
to any person or circumstances shall not be affected there-7

Like how if a guy's stopped from buying drugs in a sting because he was arrested, he's liable to the government for the money he would have paid...

Or how the US is exempt from lawyer fees if it loses forfeiture litigation involving money laundering...

Also, there's the Finders Keepers provision.

If a judge orders a seizure for criminal forfeiture, the owner is entitled to a prompt hearing.

If the government is in physical possession of the property, no judicial involvement is necessary (!!!!!) so the prompt hearing part doesn't apply anymore. There is notification though.

The Department of Homeland Security and the Department of Justice will soon be money-making organizations, people. Think about that deeply.
