PLEASEHELP - need to know what this is called -
What is it called when companies do studies on a product that show it may be harmful or hurt/maim some people, but they figure the percentage would be so small or not very costly to them, so they sell the product anyway. Sort of putting a price on a person's life...

I'm writing a letter to the editor to the Dallas Morning News or to any Texas paper that will take it about the upcoming Prop 12 which puts a medical cap on health lawsuits.

I'm writing from the perspective that a cap will hurt all of us, because it takes away a huge incentive for businesses to ensure their products safety if they aren't worried about getting hit in the pocketbook.

Please help all you smart DUers! Thanks in advance!

3. I thought Prop 12 only applied to hospital and doctors,
I don't know that it applies to manufacturers of medical devices. If it does, I'd like to hear about it.

4. same thing
If damages are capped, some hospitals and doctors will base medical services on the expense of a lawsuit instead of sound medical care. HMO's already deny care based on cost, the caps will only give them less incentive to put care over cost.

6. The Delaney Act prohibited this, but it was torn apart in l996
The Delaney Act said no harmful chemicals, but now the standard reads harmful chemicals allowed up to safe levels. The save levels were not defined. Now everyone does cost benefit analysis to determine how many can you maim or kill and still make a profit.
