Opening Arguments Heard in Court-Martial of Marine Conscientious Objector

NEW ORLEANS (AP) - A Marine reservist being court-martialed for failing to show up for active duty while he sought conscientious objector status probably would not have been sent to Iraq had he reported on time, his commanding officer testified Friday.

Rather, Maj. Lance Daniels said, Lance Cpl. Stephen Funk likely would have been kept in California.

Daniels' testimony seemed to bolster defense arguments that Funk had researched how the Marines handle conscientious objectors and did not expect any assignment critical to the war effort.

The jury of one officer and three enlisted personnel will decide whether Funk is guilty of "shirking important duty," a charge that could lead to a year in prison.

1. He should call the Commander in Chief

as a witness for the defense to testify that disobeying orders, going AWOL, not showing up for duty while country at war etc. is not a punishable offense.

6. Easy choice- don't join the military if you don't want to kill people

I mean, this one's no brainer. It's not like there's a draft going on. If you're a concientious objector- that's cool, I am too with respect to this war. But once you enlist, the deal is your ass is theirs and if you decide to disobey orders or weasel out of duty then expect to pay the consequences. In this case, it seems to me that a year behind bars is pretty reasonable- it sure beats the chance at a year's tour in Iraq.

7. He did it the way he thought he was supposed to do it

He did what his lawyer told him to do. He should NOT be punished for his filing as a Conscientious Objector. It's obvious that he wasn't shirking his duties.

When you sign up for the armed forces most folks expect to be called upon to kill other folks, but these folks expect to be called upon to kill other folks in defense of America or in an ethical war. This is not an ethical war, IMHO.
