Estes Park trustee facing recall over his refusal to say the Pledge
ESTES PARK - A federal judge today called off a recall election that was scheduled for Tuesday in Estes Park. Voters there were supposed to decide whether to remove from office town trustee David Habecker. He refuses to recite the Pledge of Allegiance at the start of board meetings. Habecker claims the "under God" clause violates the principle of separation of church and state.
Residents who were offended by Habecker's stance got enough signatures on a petition to require a recall election. But Thursday afternoon a federal judge in Denver granted a temporary injunction halting the election until a full hearing can be held on the case. Habecker claims the recall effort violates his constitutional rights of free speech and religion.
