Federal lawsuit filed against county and Firm
By C.J. Marshall
A federal lawsuit is scheduled to be filed today against the Bradford County Board of Commissioners, as well as the Firm Foundation, over perceived violations of the First Amendment of the U.S. Constitution.
Clark Moeller, representing the Bradford County Alliance for Democracy, reported that the complaint will be filed on behalf of several Bradford County citizens, including a former inmate at the Bradford County Correctional Facility, in the U.S. District Court for the Middle District of Pennsylvania.
The lawsuit, according to information provided by Moeller, indicated that the lawsuit is being filed by Americans United for Separation of Church and State and the American Civil Liberties Union. Also named in the lawsuit is the Pennsylvania Commission on Crime and Delinquency (PCCD) as well as U.S. Attorney General Alberto Gonzales. The lawsuit is claiming that a violation of the separation of church and state occurred because public tax money was used to support the Firm Foundation -- a faith-based organization located in Towanda....
...The federal lawsuit is the latest in a series of complaints filed against the Firm Foundation by the Bradford County Alliance for Democracy. The Alliance made several allegations of fiscal mismanagement against the Firm Foundation in July, charging that the organization had spent $200,000 in public money "... with at least a cavalier, careless neglect, and has not accomplished what it was being paid to do."...
..."Many religious institutions have provided wonderful services to their communities using federal funds -- including hospitals, soup kitchens, housing projects and job programs -- without violating the Constitution," said Kris Schwenke, president of the Bradford County Alliance for Democracy and one of the plaintiffs.
