Lawsuit says touch screen voting is inaccurate
The court may delay the October 7th vote because of the possibility that punch card ballots may not give an accurate result. But one local woman says touch screen voting machines are no better and she's suing the state to get her point across.

If it's not one thing it's another. Critics of punch cards say they could be punched the wrong way, making votes uncountable. Critics of computer touch screens, on the other hand, say there's no way to verify votes meaning no one's accountable for the way an election turns out.

If you vote the old way, let's say with punch cards, you know exactly what you’re turning in. But if you vote the new way, electronically, you only really know what you've pressed.

What happens from there is out of your hands. To some that doesn't matter.

But others say the lack of this kind of proof is troubling.

“These things can be manipulated mechanically.”

Nope, still there. BBV's host is fighting the cease order.

Though she lurks here and at BBV frequently. She ran for office on a Libertarian ticket.

And that's where Susan Marie Weber of Palm Desert comes in. She filed a lawsuit against the state and Riverside County's Registrar of Voters, saying with touch screen machines it's impossible to know exactly how your electronic vote was recorded.

Most voters we talked to say they generally trust the system, but it's up to the courts to say one way or the other, and guess which one's hearing the case? Yup. The 9th Circuit Court of Appeals, the same one that had a problem with those old fashioned punch card ballots.

This lady may have a fighting chance.

DUers, email her and send her encouragement. I spoke with her this week and she's going to argue the case herself. She's following BBV closely and watching everything we come up with.

The problem with this being an appeal is that she can't offer NEW evidence, only argue her case. She's planning on slipping in some of our stuff if she can.

She was going to sit with a "high powered" attorney yesterday to go over her oral arguments and our new evidence to see how she can slip it in.

Email her and let her know how much you appreciate her efforts. She can use the kudos.
