Where does it say that in the Constitution? It should be up to the elected representatives of each state to make these laws not the Court. Another attempt by the court to take over the country.

It will be interesting to see what their Constitutional justification is. A strict reading of the Constitution would not only show that the federales have no authority to rule on marijuana, but that they have no authority over any drugs whether pharmaceutical or recreational. That's one of the powers which "are reserved to the states respectively, or to the people".

cold remedies such as sudafed. The Feds want to make it back into a prescription drug... and since they have banned phynolpropanolamine (which was OTC for thirty years) for dubious reasons (my doctor ranted over that one), there are no other OTC decongestants out there that are anywhere near as effective.

In this state, we are already restricted to buying no more than two boxes of sudafed (or store brand of the same) per shopping trip...

8. So? The FDA has taken many, many old remedies off the OTC shelf

in the last twenty years for dubious reasons. Remember Terpin Hydrate? That stuff really worked on a cold and cough, but the FDA told the drug companies that they had to prove how it worked or take it off the market. The drug companies decided that it was not cost effective to run the studies needed (terpin hydrate was not a high profit margin otc drug), thus it is gone.

The same thing happened to many other OTC drugs that are no longer available. Remember paragoric. You can't even get that through prescription anymore.

Benzdrex inhalers were taken off the market for several years because the tubes could be used to inhale cocaine.

Are we to assume that three packs of sudafed is enough to make methanphetamines in large quantities?

Give me a break. I live in Allergy Alley. Pseudophederine is the only thing that keeps me and my family going in tree pollen season. If the trend keeps up, we won't be able to get it in prescription form either.

The war on drugs has been an abysmal failure; it is having too much of an impact on non-drug abusers and very little impact on drug abusers.
