Can the Gold Star Mothers sue Bush* |
|
It seems to me there is ample evidence out there now to show Bush* cooked the books so to speak on the intelligence to go to war and that cost many Americans their lives. It was unnecessary and unprovoked. It is very apparent that there is no shame in the GOP and they will back this criminal Administration until the end but the Supreme Court ruled that a sitting president can be sued and Clinton was indeed sued. Why are not the Gold Star Mothers or any mother who lost her child or had her child maimed for life suing the crap out of these bastards?

Kinda gray area with Bush* being the Commander in Chief which is a military title.
Being in the military limits you're power to sue if anything happens (have a feeling it falls for families of our fallen too since they would be sueing for the loss of a soldier / marine / sailor / airman).
I would be interested to hear if its possible. I remember times when families wanted to sue on behalf of relatives who were in in my time but it didn't get anywhere.

2. On the other hand, the Constitution states quite clearly that |
|
the President, although referred to as 'Commander-In-Chief' is a CIVILIAN authority. This was to counter the colonial trend on the part of England to make military leaders independent of and superior to the civil powers.
The President is a civilian. Sue his ass off!

5. Clinton was also Commander in Chief |
|
The Supreme Court ruled that even the President (Commander in Chief) is not above the law and can be sued by a citizen. Granted Clinton's case was different but the idea of not being above the law is still the main point.

6. Well thats true but sueing on behalf of military personel is a |
|
different ballgame.
I wish I could remember the suit that brought it to my attention back in the mid 90s (want to say it dealt with DSS), but basically it came out that there is a clause (of course!) in the contract that we sign that states if anything happens the gov't cannot be sued.
Pretty much to that effect, thats my worry about these families being able to do that.

A president is immune from suit for his official actions.
Pity, really.
