Does the fact that Bush illegally diverted money for war planning count?

I do remember that it was shown that the White House diverted funds from the war on terror (i.e. afghanistan war) to start the pre-war planning and build up. Okay. Now that the DSM is public, and having read it again just now, the UK was questioning how THEY would find funding to start the secret planning and build up to the Iraq war.

So.. for those that are more versed in this issue. What has been said about our diverting funds to a war that was not yet authorized? Isn't that cause for legal action against those that diverted money? Isn't THAT was was at the core of the Iran/Contra crimes?
