It Looks Like Rehnquist Has Resigned

Everyone this is still not confirmed and will not be confirmed until next week in my opinion but, if you are watching the Senate this morning you will know why I am doing this. I will be putting videos up shortly of Sen. Kennedy, Sen. Leahy, and Sen. Schumer. They are on the floor right now speaking about a Supreme Court appointment.

This could be a huge fight unless the President will work with the Senate on finding a nominee. I reported a story based on the "buzz" around the web earlier this week. If you would like to read that you can see it

1. They cannot simply accept another Rehnquist or Scalia type ...
... thinking it will preserve the status quo. Suppose we cannot get a reasonable replacement for Stevens. Suppose one of the Clinton appointees gets hit by a truck tomorrow.

8. Another Scalia type will NOT preserve the status quo
Edited on Thu Jun-23-05 09:24 AM by Divernan
It's not simply a matter of replacing one extremely conservative chief justice with another extremely conservative CJ.

If Scalia moves up to take Rehnquist's chair as chief justice, Scalia's replacement can change the current makeup and skew it more to the right. Even if the moderates remain, Rehnquist's departure is enough to let Bush appoint a person who will switch all the 5-4 decisions against Bush's extreme philosophy into 5-4 decisions following the Scalia/Thomas conservative direction.

One truly terrifying aspect of this to me is that the Chief Justice of the US, if it's Scalia, will be a member of Opus Dei.

10. Yeah, Scaliathomas is not conservative in the usual sense. ...
He has an active agenda to remake the Constitution in his image and likeness. Did you read his opinion in Washington v. Crawford? I agree with the result, but the reasoning is bizarre.

12. Don't think it's likely
Scalia's 69 years old. It's smarter to get someone younger who'll keep the appointment out of play for decades. Like Thomas. Or the new justice -- Chief Justice Starr, or Ashcroft... ugh.

16. Yeah, Opus Dei is one scary group.
They really are, and we need to be careful of them. I know that many in it just think it's a group to bring back the Latin Mass, but it's much more than that.

2. Hmm I wonder who he'll appoint
Will he apoint a moderate republican?

Nah.

Get ready for the most conservative judge ever to grace the bench...I don't know who but I guarantee they'll have quotes or decisions in their past...

1) To Make All Abortions Illegal
2) To Make All Gay Rights Illegal
3) To Make All Consumer Complaints Illegal

hmm...what else?

13. Talk about filibuster
if they tried to nominate Asscrack you can bet the Republiscum would have a fight on their hands. That would be the ultimate distraction to take America's attention away from all the other shortcomings and failures of this administration.

Wake me when it's over. Actually, I'll probably have to make phone calls to Senator Specter over whomever the Bushies put up, but other than that ... I'll be under the covers.
