If so, O'Connor and Rehnquist's departures might be a GOOD thing. Think about it. It narrows the Republican-appointed majority who would ultimately have to decide these matters.

Maybe the Dem leadership should insist on such a stipulation.

Scalia wouldn't even recuse himself on the Cheney energy task force case when he had been taken on a hunting trip by cheney a few weeks before. They lust for power, once they have it, they won't let go of it for any reason, for even a second, unless you pry it from their hands.

With the judges that * is going to nominate (and that the spineless dems will inevitably approve), we're fucked.
