My short list of potential indictments from the Plame Affair
These are all potentials and the potential counts indictments could be issued under:

Karl Rove - Multiple counts under Intelligence Identities and Protection Act, Espionage Act of 1917. Also counts on conspiracy, perjury, and obstruction.

Scooter Libby - Multiple counts under Intelligence Identities and Protection Act, Espionage Act of 1917. Also counts on conspiracy, perjury, and obstruction.

Karen Hughes - Conspiracy

Mary Matalin - Conspiracy

Jim Wilkinson - Conspiracy

Nicholas Callo - Conspiracy

Condi Rice - Counts under Espionage Act of 1917 and conspiracy

Stephen Hadley - Conspiracy

John Bolton - Counts under Espionage Act of 1917 and conspiracy

Furthermore, depending upon precisely what Plame did and the criticality of her work and efforts, treason charges could be brought against anybody indicted under the Espionage Act of 1917.

3. Cheney can't be indicted
Edited on Thu Jul-14-05 12:33 PM by Walt Starr
He has to be impeached.

Cheney and Bush are potentially unindicted co-conspirators.

Unless pardoned, after they have been removed from office they could potentially be indicted, though there is no precedent one way or the other on that one. Ford made sure that the precedent would not be set with Nixon by giving a blanket pardon.

7. Once Bu$h and Cheney are impeached, I presume they both can
be indicted under IIPA and Espionage Act of 1917. Is that correct?

Beyond that, I presume indictments can be brought against them in the International Criminal Court irrespective of America recognizing the ICC. Is that correct?

Thank you for the excellent list. I wonder if Powell, Feith and Rumsfeld belong on the list?

Peace.

www.missionnotaccomplished.us - How ever long it takes, the day must come when tens of millions of caring individuals peacefully but persistently defy the dictator, deny the corporatists their cash flow, and halt the evil being done in Iraq and in all the other places the Bu$h neoconster regime is destroying civilization and the environment in the name of "America."

8. That's what I'd call a home run!
Pretty much the WHIG bunch, huh? I hope Fitzgerald has enough evidence to get ALL the guilty parties.

9. What about Colin Powell - he supposedly brought the classifed
and personal file of one or the other of the Wilson's on board AF1 and this classified file made the trip with them to Africa and back.

What about Ari Fleisher who was on board AF1 and was their communicatioan person and who resigned on the same day the Robert Novak column was printed.

Perhaps you are only speaking about the one law broken, not both?

10. I am not saying my list is definitive
Edited on Thu Jul-14-05 12:49 PM by Walt Starr
Note: I did say it was my SHORT list.

Based upon everything I've read on this to date, I consider the above to be the most likely scenarios.

Definitely, arguments could be made for Fleischer and Powell, as well as potential perjury and obstruction charges against Novak.

Furthermore, if she does not testify, the last indictment handed down could be for Judith Miller over criminal contempt and obstruction.

11. Thanks. And thanks for your list - I don't know about some of them....
more study required.

A post-scandal book is being written on DU as we go - on a minute-by-mintue basis before the case is closed. We have good minds asking questions, reading other sites, and contributing what they know about the law. Hooray! We are funneling down. History is in progress.
