Why Rove will be indicted

After hearing Mr. Novak's account ... Mr. Rove told the columnist: "I heard that, too."

So, Rove "heard that too," meaning he had heard prior to talking to Novak that Wilson's wife was a CIA agent. So, when Rove said, "I heard that too," he confirmed to Novak that Wilson's wife is a CIA agent. He broke the law by confirming it.

We learned today from Rep. Henry Waxman (my congressman!) that a presidential executive order prohibits White House officials from "confirming" to reporters the identity of undercover operatives. Here's how a “briefing booklet” describes what is required of White House officials who have knowledge of secret information:

Before … confirming the accuracy of what appears in the public source, the signer of the SF 312 must confirm through an authorized official that the information has, in fact, been declassified. If it has not, … confirmation of its accuracy is also an unauthorized disclosure.

In this case, when Rove spoke to Novak, Rove violated his oath of office by providing Novak with "confirmation of its accuracy" -- the accuracy of Wilson's wife being a CIA agent. Remember, Rove said to Novak, "I heard that too." That was illegal. He will be prosecuted.

That's about as simple as you can get. I'm thinking maybe Monday for Rove and then the roll starts. There could be delays for a couple of weeks while this guy squeezes Miller, maybe put her in with some really mean women prisoners. Then she'll crack. She said she's afraid of the WH. She's obviously never dealt with a Federal prosecutor.
