Question About Driving With only a Permit

My friend and I took drivers training together over the summer. We were taught the basics of driving and even night driving and on the interstate. He is almost 16

Since I am older than him I was able to get my license. Yet he will be able to get his in less than a month. He wants to practice driving but because his mom dont have his license he drives by himself occasionally. He has his own car and even has insurance. He is really a great driver even better than me most times.

I know its definately a not wise of him to do so but I really dont see much harm in it seeing as its the only way he can practice before the test and he has to get back and forth to work.

My mom dont approve of it but dont mind it either. I asked him what would happen if he got pulled over and he said he would just tell them the truth and get it over with.

My question is for one what punishment under INDIANA law will he get, and two is it really a major cause for concern? He is a good kid he dont smoke or drink or anything, ive had a friend get in a minor car accident with out his permit even in a car that wasnt his and he only had to pay a small fine.

1. umm... he might want to think twice, and see if he can get an adult

to help him out so he can get his license.

Driving without a license
Sec. 1. (a) A person, except a person exempted under IC 9-24-1-7, who:
(1) operates a motor vehicle upon a highway; and
(2) has never received a valid driving license;
commits a Class C misdemeanor.
(b) In a prosecution under this section, the burden is on the defendant to prove by a preponderance of the evidence that the defendant had been issued a driving license or permit that was valid at the time of the alleged offense.

Driving records; unlicensed persons
Sec. 9. (a) The bureau may establish a driving record for an Indiana resident who does not hold any type of valid driving license. The driving record shall be established for an unlicensed driver when an abstract of court conviction has been received by the bureau. The record shall be maintained for not less than three (3) years for each unlicensed driver.
(b) If an unlicensed driver applies for and receives any type of driving license in Indiana, the person's driving record as an unlicensed driver shall be recorded on the permanent record file. An unlicensed driver who has had at least two (2) traffic violation convictions in Indiana within twenty-four (24) months before applying for any type of driving license may not be issued a license within one (1) year after the date of the second traffic conviction as indicated on the abstract of court conviction record. If the bureau issues a license without knowledge of the second conviction, the bureau shall suspend the license upon learning of the second conviction and notify the person of the reason for the suspension and the term of the suspension.
(c) The bureau shall also certify traffic violation convictions on the driving record of an unlicensed driver who subsequently receives an Indiana driving license.

2. If he gets caught

he will lose the priviledge to drive for a long time. Plus probably pay a hefty $$$ , and may even have to pay to go to extra Driving Safety classes...depends on the state you live in.

Plus if he wants to have a career as a professional driver at some point, it may delay that choice. And he may even have issues with non-driving jobs on applications and such...the job market is tight enough without any blemishes on your record.

If he is smart he won't take the chance. Patience is a virtue, legal age can't be that far away...but I know it's hard to see that when young.

4. I wouldn't worry too much about it I drove a car at age 8

yes, on city streets and when I was 12 I ran my paper route in my dad's 1953 Ford and learned to operate a bulldozer...then flew solo in a plane at 14. Age isn't the only criteria for responsible activity.

but we don't do that anymore. Nowadays the cops will roast your ass for driving permit only.

6. Why take the chance?

Your friend could lose his license and may have to wait until 18 or older.

I started at 12, but I lived in a farm town and the work I was doing required it. But it was a long time ago and people didn't worry about it.

Times are way different. It's not something to mess around with and if he wants to keep his license, tell him to stay patient. It's not worth the trouble. The fines are much higher and so is the insurance if he gets caught.

It's no big deal to wait, but a bigger deal if he's caught.

7. Here in Tennessee

you have to have an adult drive with you if you have a permit. No matter how old you are since you are learning. I would advise him to have you with him since you have your licenses or have another friend or family member who has their licenses.

10. Wouldn't work in Indiana

Since he's under 18, the passenger has to be a parent or a relative.

11. He can get his license in LESS THAN A MONTH?

Then he should just WAIT! If he gets into an accident, with NO LICENSE, he could sued and CHARGED with a crime. Not to mention, his insurance rates WILL GO UP!

he could be unable to get a license until he's 21, if he gets caught.
