62% of Americans think Judy doesn't belong in jail!
Just in Schneider's comments on Lou Dobbs program today!

Schneider was he was surprised because the public usually doesn't side with the media.

That coupled with the 75% think ShrubCo is NOT being fully cooperative in the investigation, and 53% say they are following the story closely, looks like bad news for Shrub to me!

7. well, the principle is becoming rather hollow...
...with everyone else giving up their sources. If she can no longer protect her source's confidentiality, what principle is she "doing this on?" After a point, she's doing it for herself, not for her source.

As for the rest of your comment, I'd say that Miller is everything and more that she's been accused of here. She was an utter shill for the WH lies about Iraq's WMDs-- a virtual press agent for Rumsfeld and Chalabi. She is as responsible as Bush and Cheney for selling those lies to America. What should a journalist's reputation be when the overwhelming majority of their stories turn out false?

This isn't about protecting whistleblowers,
this is about protecting members of the regime,
helping them deep-six a whistleblower and her entire organization.

Not just any organization — the one that looked for illicit WMDs.

What was it ** said he sent us to war for again?

11. Journalistic privelege
Now, I like to think I have a pretty clear view of all this: I think Novak should have to testify, because his printing of her name was not a journalistic act, it was an act of aggression. Miller, on the other hand, never even wrote an article with this information in it; it was in her notes, and I have no idea why Fitzgerald decided to go after the reporter who never even used the information rather than the one directly involved in the crime.

The answer seems fairly obvious to me-- it's because he is a special prosecutor and she has information relevant to the crime he's investigating. What she did with that information has no bearing whatsoever on whether he should seek her testimony. If you know with absolute certainty who robbed a bank-- as Miller knows with absolute certainty who divulged Plame's identity to her-- whether you do anything with that information has no relevance to your responsibility to testify if asked.

Novak has already testified before the grand jury-- the fact that he's still free is pretty good evidence that he answered their questions. Finally, your comments implied that Novak was "directly involved in the crime" but that Miller was not. The crime was a breach of U.S. security for dirty politics-- it seems to me that Miller was just as involved in that as Novak, since both of them agreed to receive that information.

on edit-- I think I'm just a adament a proponent of journalistic privilege as you are, but this case really does seem like one in which the leaker was USING the reporters to aid in committing the crime.

Rove and Libby have already been outed as Matthew Cooper's sources. If they were also Miller's "sources", why does she need to remain in jail? Wouldn't she just say Rove and Libby were the sources she was trying to protect, too?

She's protecting someone else.

Cooper didn't believe it was valid for Rove. It probably is.

Under what logic has she not broken the law by not complying with the lawful order of a Judge to testify when in fact nothing about the woman offers her special privilege not to testify? Who in fuck is she NOT to have to go to jail?

13. The only reason I dion't think she should be in jail is the same
reason I didn't think Susan McDougal should have gone to jail in the Clinton investigation! I really believe if someone is determined not to testify, for hwatever reason, they're just not going to, and it doesn't matter how long you incarcerate them.

That's why the Justice Dept had investigators! Find some other sources! With a plot this big, I'm sure there are more than Fitz needs!

That's one of those questions that can be framed in many ways to get different results.

People are confused. They generally see a reporter going to jail as being someone protecting a whistle-blower or being picked on by the big bully government. Call it the civil libertarian in all of us who shudder at the thought of being thrown in jail for first ammendment rights.

They don't see Miller's bigger role in this mess...how she's played into this regime's previous misinformation campaigns and the reason she's in jail isn't because of what she wrote, but what she didn't. It's that she's withholding information not only a federal prosecutor, but several federal judges and even the Supreme Court feel rises above her press shield privilidges.

When her true role becomes known, Judy could be one of the most tragic figures in this sorrid affair.
