If he's not confirmed by the senate. He won't be if * is in the middle of an impeachment. But of course * won't be impeached by a republican senate so it doesn't matter.

Unless you impeach him, too. For that he would have to stand trial in the Senate, presided over by the SCOTUS chief... just like a President.
