Was she covert? Yes.

How could we know this? We technically could not because what she did is still classified. Even Joe Wilson cannot talk about whether or not she was covert.

How DO we know this? The CIA started an investigation sighting this law as the one that was broken. The CIA knew whether or not she was covert and would only call an investigation into this matter if she was indeed covert. Otherwise, they would not have even brought up this law.

Also, Joe Wilson basically said that Novak took away her ability to be covert when he outed her. If you can read between lines, you know she was indeed covert.

Add on to this that we know the paragraph in the memo was marked "Secret" which is what the CIA uses for covert CIA agent names.
