I think it was more of a "there's going to be an investigation." Period. No 'no shredding'.....just an informal call from one Bushie to another. This wasn't a formal notification, that occurred the next day.

The phone call happened around 8:30pm. Not late.

There is also the issue of Gonzalez basically lying to Justice.

Because Gonzales didn't send out an email generally--or for that matter, station security or lawyers on every floor--there isn't anything to prevent Card from, oh, offhandly mentioning the coming DOJ search for documents to one or two chosen people in a way that isn't recorded. In an elevator, for example.

So those two people decide to empty a wastebasket or two and clean off that silly credenza before there is any PROVABLE communication to them to not destroy anything. They'll deny knowing anything about what Gonzales told Card.

And those two will tell two, etc. A lot can disappear in eight hours in an office where people tend to be there 18 hours a day.

In fact, if Gonzales had simply NOT told card, there is more chance of catching somebody just in the odds.
