If Bolton gets recessed....does he receive Diplomatic Immunity?
And would this immunity be retroactive, meaning he can't be brought to trial for charges brought forth by the Special Prosecutor?

The reason I ask this is because I believe he is one of the targets of Fitzgerald's GJ. I believe he has been a target since the very beginning when the case was referred to the Justice Department.

Just wondering if anyone knows.

2. Define diplomatic immunity.
He's a citizen of the United States and will be held liable by the United States for laws he's broken.

If he were, say, in Luxembourg as a US diplomat, then he would have diplomatic immunity in Luxembourg. But, as a citizen of the United States, he can't be immune from US laws.

9. Thank you.
And thanks to everyone else who answered. How would a recess appointment to the United Nations affect a Bolton under criminal indictment? Will this affect whether or not he testifies in any subsequent trials. I just need to know how it could affect Fitzgerald's case.

3. Diplomatic immunity only applies OUTSIDE the US.

American diplomats are still subject to prosecution under American law for any crimes or misdemeanors committed in this country.

4. Yes.
He would have diplomatic immunity from the moment he's sworn in. But it would NOT be retroactive.

Of course, whatever he's done, Chimp could always pardon him.

I'm not a lawyer, but I'm quite sure about this.

6. Reason they tried to use to keep Condi from testifying before 9*11 hearing
wasn't that it was because she was appointed? Didn't work with her, but can the same argument be made for Bolton when he's apponited?

8. The UN could refuse to seat him
They could, but they wont, lest they provide political raw meat to the Sean Hannity's of this country.
