After months of hate mail, no choice but to move

No choice but to move

After months of hate mail, interracial Smithtown family relocates

BY THERESA VARGAS
STAFF WRITER

August 12, 2005

For months, Lois and Mitchell Fuchs put up with the hate mail flooding their mailbox -- slurs aimed at her because she's black and at him because he's Jewish. Then came a typed note, bearing the words, "Where's Hitler when you need him?"

<snip>

"We didn't know where else to go," Lois Fuchs said. "My parents just moved to North Carolina and they said, 'Please come, we don't have those crazy people here.'"

<snip>

Smithtown is considerably less diverse than not only neighboring towns, but the rest of the nation. According to the latest census figures, 95.5 percent of Smithtown's 115,715 residents are white versus 75 percent for the nation. Less than 1 percent of the town's population is black, like Lois Fuchs, or two or more races, like her children.

<snip>

Lynne Niebuhr, who lives across the street, said she was upset over the unkempt condition of their house. "That's the only thing I had against them -- just clean your house," she said, adding that it was never about race, as far as she knew.

"We had lovely Negro, um, African-American neighbors to the left and right," said Niebuhr, who is not suspected of sending the mailings. "I think all that was blown out of proportion."

<snip>

"As a parent, I feel I am doing the right thing" by leaving, Lois Fuchs said. "If it was just us we would stay and fight it. With the kids, it's not worth it."

I'm quite sure some of those sending the hate mail are listed in their computer databases.

"Smithtown is not a racist community, but there will always be someone full of hate who will act in such a terrible way," Vecchio said.

Any town which abides racism, which doesn't expose the racists, which harbors the racists by remaining silent IS a racist town. And it seems to me it's more than some 'one' person doing this, contrary to what Vechhio thinks.

110. An otherwise intelligent grad school friend of mine was literally
afraid of African-Americans. When he walked home with me to have dinner with me and my housemates, he wanted to walk on the other side of the street when he saw a black father and son washing their car in the driveway two houses down from mine.

His attitude made no sense to me until someone else told me that the part of New Jersey he came from was the quintessential white flight suburb.

I remember recently reading a report about LI being among the most segregated communities in the country.

I was at an ACE hardware store in the beginning of the summer and the kid working the counter was talking football with the guy in front of me and told of how his family moved when he was younger because Valley Stream was "getting a little too dark."

32. In a racist's eyes - you have the sexual predator black male
going after the "pure" white . . . it's the old stereotype.

I had a conversation with a co-worker years ago. She (black) told me that interracial couples were taboo on TV.

Me, "thinking", said "Wait, what about the couple on The Jeffersons"?

She pointed out that it was much more acceptable, socially, for a white man to marry a black woman (White males impregnating their black slave women to produce more slaves) than ANY black male with a white woman.

I had to concede her point.

So, if you think that the attacks were bad when you had a white male marrying a black female, it would have been ten times more vicious the other way around.

27. NO crime committed? WTF?
I think ole Mrs. Neat-freak across the street needs to submit to a DNA sample request.

Funny how the authorities can twist and turn laws to "find" violations when they want to. I suppose they would have the same attitude if those letters were being sent to the chief of police or the mayor. Look cross-eyed at a cop in most jurisdictions and you get, at least, a "disorderly conduct" charge that usually gets tossed out in court.

At the very least, they should investigate this "non-crime" to the point of finding out who the "non-perpetrator" is so they can put him/her on notice.

35. Disorderly conduct.
Without seeing the letters it would be hard for me to trump up a charge but, like I said, disorderly conduct is a nice catch-all when the cops need to arrest someone.

Or, how bout this? If they can track the letters, have the feds question the sender and nail them for lying to a federal agent. Ala Martha Stewart.

49. How about terroristic threatening?
The Hitler remark seems to imply that they want them dead, and that seems to fall under the legal definintion.

Under HRS § 707-715 (1993), a person commits the offense of terroristic threatening

if the person threatens, by word or conduct, to cause bodily injury to another person or serious damage to property of another or to commit a felony:

(1) With the intent to terrorize, or in reckless disregard of the risk of terrorizing, another person; or

(2) With intent to cause, or in reckless disregard of the risk of causing evacuation of a building, place of assembly, or facility of public transportation.

60. I can't grasp your line of reasoning here
If someone sends hate mail to a couple where one is Jewish and the other is African-American and states "Where's Hitler when you need him?" what are they saying? That Hitler would build a nice autobahn so they could drive out of the area or a gas chamber. It seems pretty obvious that the letter writer is saying that he wishes they would that they would be murdered.

64. As a Historian, I reckon I have a different view
Hitler is best known for one thing, the murder of nearly 10 million people merely because of their religion, sexual orientation, political views, physical disabilities, etc. It's a threat, not one where the letter writer says "I will kill you." but rather an implied threat, which fits under the legal definition to terrorize somebody.

If someone sent a person hate mail wishing that Hitler was around it can only mean one thing, they want that person dead.

69. Exactly! Investigate!
Knock on their door. Let them know that they know who is sending the letters. Ask them what they meant by the letters. You would be surprised how often dip-shits like this incriminate themselves during initial police contact. After all, we are not dealing with rocket scientists here. Cops make contact all the time to keep the peace without intending to make an arrest. That's why they are called peace officers.

I'm not talking about kicking the door down and seizing property. A knock on the door will be a good start and as the other poster said up-thread there might be a case for terroristic threats. The investigation alone could lead to a charge.

Unless you don't think running someone out of their home and terrorizing a nine year old is worth a look-see?

The victims may or may not have an idea about who they should talk to, maybe based on previous interactions with neighbors. I don't know. But that's not what we are discussing here. You, apparently, do not think any laws have been broken. I have a pretty good idea that they have.

Here. Need anything else?:

Bias-related crime can be broken down into two legal categories: aggravated harassment in the first degree (NYS Penal Code Sec. 240.31), which is a Class E Felony, and aggravated harassment in the second degree (NYS Penal Code Sec. 240.30), which is a Class A Misdemeanor. Both types of offenses, as well as any other acts or threats of racial or religious intolerance are viewed as serious, and such investigations are given priority by University Police.

WHAT IS THE DIFFERENCE BETWEEN FIRST AND SECOND DEGREE HARASSMENT? According to the New York State Penal Code Sec. 240.30, subdivision 3, aggravated harassment in the second degree reads: "Strikes, shoves, kicks, or otherwise, subjects another person to physical contact, or attempts or threatens to do the same because of the race, color, religion or national origin of such person."

Aggravated harassment in the second degree is a Class A Misdemeanor. According to New York State Penal Code number Sec. 240.31, a person is guilty of aggravated harassment in the first degree when, with the intent to harass, annoy, threaten or alarm another person, because of race, color, religion or national origin of such person, he or she:

Damages premises primarily used for religious purposes, or acquired pursuant to Section 6 of the religious corporation law and maintained for the purpose of religious instruction, and the damage to the premises exceeds fifty dollars; or Commits the crime of aggravated harassment in the first or second degree within the preceding ten years.

Aggravated harassment in the first degree is a Class E Felony.

93. The police are investigating
"Suffolk County police began investigating the mailings in March"

but not the feds

"Officers with the Hate Crime Bureau enlisted the help of the FBI and the postal service, but said Thursday they were unable to move on the case because no laws were violated."

And they have been looking into this for a while now.

"This could go on for a long time," said Det. Allen Van Winkler of the Suffolk County Police Bias Crime unit. The volume of mailings is helping authorities build a case against the culprit because it shows a "continuous course of action" with "no legitimate purpose," he added.

A second-degree aggravated harassment charge is punishable by 30 days in jail and a fine.

The couple received more than a half dozen mailings, and their neighbors, the Ciprianos, got five or six more. Those were addressed to Rachel and Giovanni "Nastylovers," as Fuchs' daughter might put it.

"I don't think we should have too much problem identifying the person responsible," Van Winkler said. "This is a person probably in the neighborhood who has a problem with a particular person or a particular group.

http://www.newsday.com/news/local/longisland/ny-libias0409,0,2636557.story?coll=ny-top-headlines

So I reckon a crime has been committed, just not a federal one.

Just-downright-ugliness.

Wartime anger based on unfounded rumor has brought some of the most grievous trespasses against freedom and democracy in our nation's history, and thus wartime leaders bear a special responsibility. Demagogic appeals to our baser natures threaten our traditions. Appeals to truth and reason work to preserve them.

114. Well actually, it was a simple mistake.
Call it stupidity on my part. I did not read the article as thoroughly as I should have.

However, it is a fact (sorry to disappoint you) that the bible belt has far more organized racist organizations than any other part of the United States. This is not your fault, and it is not my fault. It is simply the way it is.

Now consider the population of New York, check the number of their organizations here:

http://www.tolerance.org/maps/hate/state.jsp?S=NY&m=3

South Carolina leads the nation with 47. That is a pretty striking general population to racist organization ratio.

It is a nationwide problem though. While statistically more prevalent, the Bible belt is not the only place this problem occurs.

112. I realize that the problem is nation wide.
However, when you look at the number of organized groups versus the population, the Bible Belt takes the organized racism trophy.

Consider the population of New York. Compare that to the number of organizations here:

http://www.tolerance.org/maps/hate/state.jsp?S=NY&m=3

Now, South Carolina has 47 organizations. That is a pretty large difference.

I agree though, racism is a nation wide problem. We have an active chapter of the National Alliance here. They are pretty spooky.

115. Ya, it was a stupid mistake on my part.
I did not read the article correctly.

However, it is true that South Carolina does have a greater number of organized racist outfits than any other state in the nation. This does not make everyone in the south a racist, and it does not mean that this problem is limited only to the south.

It simply means what it does. South Carolina has the highest number of racist organizations. It is also true that the numbers are considerably higher for these organizations throughout the bible belt.

This the link for New York:
http://www.tolerance.org/maps/hate/state.jsp?S=NY&m=3

It is also true that not every racist belongs to an organized outfit. It would be pretty difficult to quantify that group however.

125. I did not read the article correctly.
The number of organized racist groups, or racist crimes in an area is about the only way I know of how to quantify "racism" by region. This does not include everything because not every crime is reported, and not every racist belongs to an organization.

If you check the link I provided, you will see that there are also "organized racist groups" in New York. It is possible, if not likely, that the "hate mail" referred to in the article was generated by someone associated with one of those groups.

The reason I mentioned racist groups in South Carolina was because I read the article incorrectly. It was a mistake.

This does not change the fact that the majority of organized racist groups can be found in the "bible belt" with South Carolina being the home of the greatest number. Texas and Florida (the buckle of the bushtapo belt) also have many active racist groups.

Racism, or hate crime, is a national problem as you know. There appears to be a link between organized racist groups, religion, and conservative politics. This does not make all southerners or all religious people racist. It just means that a majority of organized groups are in the South, and most of their members consider themselves religious.

I would hope that these groups represent a vast minority of people wherever they happen to organize.
