A pregnant teenager went to the county courthouse in Memphis early this summer, saying she wanted an abortion. The Circuit Court judge refused to hear the case and said he would recuse himself from any others like it.

Judges, however, are starting to opt out. Other judges of the Shelby Circuit Court have recused themselves like McCarroll, and now, according to one judge, only four of the nine judges on the court hear such abortion applications.

Judges in Alabama and Pennsylvania also have said they will not take such cases.

McCarroll's decision prompted 12 experts on judicial ethics to write to the Tennessee Supreme Court in late August. The experts called his action lawless and said they feared his approach could spread through the nation and to subjects such as the death penalty, medical marijuana, flag burning and divorce.

"Unwillingness to follow the law is not a legitimate ground for recusal," the letter said

After all, the zealots made a big show about how pregnant teenagers could just petition before a judge if they couldn't speak with their parents, and wouldn't that be simple and make the stripping of rights to control one's own body alright. So of course there had to be a catch, and we just found it.

Act nice? Hell with that! I dare some Vichy Dem to tell me I should just shut up about my health care and rights.

they have overtaken our country. and the problem???? Even thought they are not the majoprity.....they SPEAK UP and ACT. Regular old americans are so totally apathetic that they're just gonna let it happen. unless it affects them PERSONALLY, they dont give a flying shit. ITs time to take this country back, but nobody else is gonna rise up and do anythuing. They have dates at the country club they cant miss.

You should count your lucky stars. If some anti gay bigot declined to preside over a case in which I was a party I would thank God and move on.

5. how is this different than jury nullification?
refusal to follow the law as an officer of the court is grounds for contempt charges being filed
