"§ 5191. PROCEDURE FOR DECLARATION {Sec. 501}

1. Request and declaration

All requests for a declaration by the President that an emergency exists shall be made by the Governor of the affected State. Such a request shall be based on a finding that the situation is of such severity and magnitude that effective response is beyond the capabilities of the State and the affected local governments and that Federal assistance is necessary. As a part of such request, and as a prerequisite to emergency assistance under this Act, the Governor shall take appropriate action under State law and direct execution of the State's emergency plan. The Governor shall furnish information describing the State and local efforts and resources which have been or will be used to alleviate the emergency, and will define the type and extent of Federal aid required. Based upon such Governor's request, the President may declare that an emergency exists.

2. Certain emergencies involving Federal primary responsibility

The President may exercise any authority vested in him by section 502 or section 503 <42 U.S.C. § 5192 or § 5193> with respect to an emergency when he determines that an emergency exists for which the primary responsibility for response rests with the United States because the emergency involves a subject area for which, under the Constitution or laws of the United States, the United States exercises exclusive or preeminent responsibility and authority. In determining whether or not such an emergency exists, the President shall consult the Governor of any affected State, if practicable. The President's determination may be made without regard to subsection (a).

§ 5192. Federal emergency assistance {Sec. 502}

1. Specified

In any emergency, the President may--

1. direct any Federal agency, with or without reimbursement, to utilize its authorities and the resources granted to it under Federal law (including personnel, equipment, supplies, facilities, and managerial, technical and advisory services) in support of State and local emergency assistance efforts to save lives, protect property and public health and safety, and lessen or avert the threat of a catastrophe;

2. coordinate all disaster relief assistance (including voluntary assistance) provided by Federal agencies, private organizations, and State and local governments;

3. provide technical and advisory assistance to affected State and local governments for--

1. the performance of essential community services;
2. issuance of warnings of risks or hazards;
3. public health and safety information, including dissemination of such information;
4. provision of health and safety measures; and
5. management, control, and reduction of immediate threats to public health and safety;

4. provide emergency assistance through Federal agencies;

5. remove debris in accordance with the terms and conditions of section 407

6. provide assistance in accordance with section 408

7. assist State and local governments in the distribution of medicine, food, and other consumable supplies, and emergency assistance.

that's when the delay came...he wanted all control on La...and who knows the real reason why he did

the LA gov said "no".

3. Those 'negotiations' didn't come into play....
until DAYS after...the focus must stay on those three days when government spokespeople said help was there and news reporters and local officials said it was not. We need to remember those three days when the lack of action took its toll.

5. Looking for information on what Blanco DID order..........
regarding LA National Guard.

How many did she call up before, and after, Katrina? What were their instructions? Could she have ordered Guard helicopter rescues and food drops?

I'm asking because * supporters are asking. The buck stops with Bush, but I would like answers to these questions and can't find it.

I have been looking, too.

I read the letter, and she did mention the guard in the letter. However, I want to know when and how many she called up. My father and some other family members were spewing Faux talking points, and I could only refer them to the letter.

11. Bush counterattack!
My Bush-loving coworkers came armed today to support their man. Dumping blame on Blanco and Nagin. Blanco for not requesting NG earlier and Nagin for failure to evacuate the city. Looters get a lot of blame.

Divided we are...

7. considering many are "serving the country" in Iraq the La Nat Guard
was overwhelmed. They only had 4 to 5000 troops.

Listening to La TV many were deployed to futher stop the water at the intial crisis.

There jsut was not enough people for the state.

Playing politics for giving more power to Bush/Feds and delaying help
is silly - if not criminal

8. We know there were 200 NG at the Dome before the hurricane

hit, we saw them searching the evacuees before they were let in. We know there were only a total of 250 NG in NO in total. A better question to ask is: How many of the 40% of the NG that was not in Iraq were, in actuality, administrative and active soldiers? My bet is it will be a high percentage.

Ask the question: How many helicopters, etc, were left in Louisiana versus in Iraq?

Ask how many actual active troops were available for the Governor to call upon.

Someone got Gen. Honore down there. Who issued that request and when and when was he finally authorized to go into N.O.?

Katrina Becomes a Category Three Hurricane, Aims Towards Northern Gulf CoastAt 5 a.m. EDT, the eye of Hurricane Katrina was located by radar near latitude 24.4 north and longitude 84.4 west, about 435 miles southeast of the mouth of the Mississippi River and about 165 miles west of Key West, Florida. Katrina is moving toward the west-northwest near 7mph and a gradual turn to the west and west-northwest is expected during the next 24 hours.Maximum sustained winds have increased to near 115 mph with higher gusts. Hurricane force winds extend outward up to 40 miles from the center and tropical storm force winds extend outward up to 150 miles. Estimated minimum central pressure is 963 mb or 28.44 inches.

Katrina is now a Category Three hurricane and some strengthening is forecast during the next 24 hours. Reconnaissance aircraft data indicates that the Katrina has also become a larger hurricane.Storm surge flooding of 2 to 4 feet above normal levels can be expected along the southeast coast of Florida in areas of onshore flow east of Cape Sable and in Florida Bay. Storm surge will gradually subside today. Rainfall from Katrina is expected to slowly diminish across the lower Florida Keys though an additional 1 to 2 inches of rain is possible in some of the heavier rain bands. Isolated tornadoes are also possible this morning over the Florida Keys. (National Hurricane Center, media sources)


State of Emergency Declared in Mississippi, Louisiana Due In anticipation of a possible landfall, Mississippi Governor Haley Barbour and Louisiana Governor Kathleen Blanco declared States of Emergency Friday.

In Louisiana, New Orleans is of particular concern because much of that city lies below sea level.According to Gov. Blanco, Lake Pontchartrain is a very large lake that sits next to the city of New Orleans and if the hurricane winds blow from a certain direction, there are dire predictions of what may happen in the city.

18. the feds out and out lied about this
to the Washington Post, who took their word for it (when will they learn? :eyes:)that she hadn't declared a state of emergency after Katrina, when in fact she'd done it a couple of days before the hurricane. (This is what I heard on AAR.) The WaPo later had to correct themselves but I guess CNN et al reported what they'd first seen in the Post. Retractions are so boring....

So not only are they playing "pin the blame" instead of taking care of business, they aren't the least bit shy about BALD-FACED LYING to cover their sorry, incompetent asses.

RANCHO CUCAMONGA, Calif. (AP) — President Bush on Monday pledged extensive federal help for victims of Hurricane Katrina to "get your lives back in order." The government put into effect a massive emergency assistance program that included rushing baby formula, communications equipment, generators, water and ice into hard-hit areas.

"It's a storm now that is moving through and now is the time for governments to help people get their feet on the ground," Bush said. "For those of you who are concerned about whether or not we are prepared to help — don't be. We are."

He added, "We're in place, we've got equipment in place, supplies in place and once we're able to assess the damage we'll be able to move in and help those good folks in the affected areas."

The Federal Emergency Management Agency had medical teams, rescue squads and groups prepared to supply food and water poised in a semicircle around New Orleans. (Related item: FEMA ready to test recovery procedures)

"I was impressed with the evacuation. Once it was ordered it was very smooth," FEMA Director Michael Brown said in a telephone interview with The Associated Press.

THE PRESIDENT: This morning I spoke with FEMA Undersecretary Mike Brown and emergency management teams not only at the federal level but at the state level about the -- Hurricane Katrina. I've also spoken to Governor Blanco of Louisiana, Governor Barbour of Mississippi, Governor Bush of Florida, and Governor Riley of Alabama. I want to thank all the folks at the federal level and the state level and the local level who have taken this storm seriously. I appreciate the efforts of the governors to prepare their citizenry for this upcoming storm.

Yesterday, I signed a disaster declaration for the state of Louisiana, and this morning I signed a disaster declaration for the state of Mississippi. These declarations will allow federal agencies to coordinate all disaster relief efforts with state and local officials. We will do everything in our power to help the people in the communities affected by this storm.

Hurricane Katrina is now designated a category five hurricane. We cannot stress enough the danger this hurricane poses to Gulf Coast communities. I urge all citizens to put their own safety and the safety of their families first by moving to safe ground. Please listen carefully to instructions provided by state and local officials.


On another matter, today Iraqi political leaders completed the process for drafting a permanent constitution. Their example is an inspiration to all who share the universal values of freedom, democracy, and the rule of law. The negotiators and drafters of this document braved the intimidation of terrorists and they mourn the cowardly assassination of friends and colleagues involved in the process of drafting the constitution
