The Judy File: Is Miller Getting Ready to Sing?

Buried in the middle of this afternoon's Reuters story on Miller, her lawyer, Floyd Abrams, offers up a bombshell: Miller is looking for an out.

When asked if talks were under way to secure Miller's testimony and release, Abrams replies: "If there are any discussions, they would be private." This after earlier insisting that Miller remained "resolute" about not revealing her confidential source.

If she is so "resolute" why get all cutesy about it? Why not just say, "No, she's not talking. And that's final"?

Well, according to a source with inside knowledge, it's because there are definitely negotiations under way. "Reuters buried the lede," said my source. "But it's there if you read between the lines... Abrams says that Miller 'made a promise and, unless properly released from her promise by her source, she has no choice but to continue to take the position that she's taking.' He's giving her more outs than an extra-inning baseball game. 'Unless properly released from her promise...' In other words, she's bargaining. All this time she's theoretically been standing on principle, and now she's come down from her principled perch and is bargaining."

I don't doubt that she will. She didn't get the pity reaction she expected from the public. This in effect has not set her up as the martyr she expected but put her future career in jeopardy.

23. I've got to back you up on this.
As I understand, Fitzgerald is not the type of person to drop a case like this. The fact that he has not yet handed down indictments does not mean he will *not* do so. In fact, it likely means that he *will*. Otherwise, he would release the GJ from the case and move on to other things. This would entail a public announcement of such.

No. The indictments are still coming. The delay could be any number of things, including:

1. Going after big fish and not yet ready.
2. Congress on vacation.
3. Katrina.
4. What good is indicting big fish if Congress will not likely act on it. (???)
5. Needs Miller to firm up the case and is not in a hurry because of #4.

Any other combination of above and probably other reasons.

Also, one more.

6. These things take time. Be patient.

27. I think it will happen on a Friday afternoon.
Just like the Watergate GJ indictments. Slow news day. Let the public and the press chew on it a little before the feeding frenzy on Monday morning. ...especially if, like the Watergate indictments, there is a sealed memorandum naming unindicted co-conspirator(s). Not that under seal would do any good. The press would find out what it meant soon enough, just like in Watergate.

Sources close to the Chicago federal grand jury probe into perjury and obstruction charges against President Bush and others said indictments were handed down this week, but a spokesman for the U.S. Attorney’s Office of the Northern District of Illinois refused to comment.


So if this is true, the indictments have been handed in and they are making no comments about it.

21. I thought the Plame investigation involved
a Grand Jury in DC. The Chicago Grand Jury is investigating non-related issues. When I read that entire article, it seemed too good to be true. I'm suspicious but we'll see soon.

For one. The grand jury is meeting in DC, not Chicago!! That pretty much makes the rest of the article a bunch of contrived bull which it certainly is.

34. Fitzgerald took a while to get indictments handed down for the George Ryan
corruption scandal in Illinois. We all knew our former governor was a crook. Editorial after editorial urged prosecution of all criminals associated with the scandal.

Then people connected to Ryan started singing like canaries. We all know what happened. Multiple convictions.

Fitzgerald will not seek indictments unless he has an airtight case. He knows the importance of this when dealing with politically explosive cases. I'd rather him be assured of getting convictions than rush to indict and have the scum walk.

The true bills were issued I heard.....so Judith Miller is the last puzzle. She sings to the prosecutors, like certain lawyers are discussing then the whole case becomes complete.
