incompetence. Here comes more. Worked for Steve Jones Timothy McViegh's lawyer, told FBI they had to be joking when they said Browne was going to be at FEMA on national level. Jones and his partners split their law firm- wanted keep as many as employees as possible, decided to keep 35 of 37. Brownie was not one of the 35. Wow!

1. Section 1001 of the federal criminal code
There also happens to be an inquiry "into offenses against the criminal laws of the United States" that the special grand jury might want to conduct. Section 1001 of the federal criminal code provides that anyone who "knowingly and willfully ... makes any materially false, fictitious, or fraudulent statement or representation" in "any matter within the jurisdiction of the executive, legislative, or judicial branch of the Government of the United States" is guilty of a felony punishable by up to five years in jail. If the report about Michael Brown having lied about his credentials is correct, he may have committed that crime both in giving his resume to the White House (which it relied on in nominating him) and in giving information to Congress in connection with his confirmation hearings - arguably with disastrous results for the people of the Gulf Coast. If his conduct did violate the law, others who knew he had overstated his qualifications may have aided and abetted an offense - which is also a crime.

So all that needs to happen is for anyone who thinks it's a good idea to write to Mr. Fitzgerald and ask him to bring it to the special grand jury's attention (which the law says he must do if asked), and ask him to recommend that they investigate (which he might decline to do - but he might not if he gets the impression it's in the public interest). And no need to worry that the grand jurors have enough on their plate before their term expires next month: the jury itself can tell the judge that their business isn't complete, and automatically get a six-month extension. The court can also appoint a new special grand jury if it decided that one isn't enough.

That kind of investigation might produce more objective results than the ones proposed by the White House and the Congressional leadership.

23. Yeah and I know just where to start. Lieberman. He was in charge
of the conformation hearings. We should demand that he demand to find out if Browne falisfied his resume, which is a violation of the law. So circulate Lieberman's phone number. Flood his office and ask how he will address this alarming issue. You can use my suggeston to start a thread in the activist section if you like, Bucky.

WASHINGTON - In 2002, a pair of FBI agents showed up at a small, well-known law firm near Oklahoma City, asking questions about Mike Brown, a former employee being considered for a job at the Federal Emergency Management Agency.

There, Stephen Jones, a lawyer best known for defending bomber Timothy McVeigh, recalled how he hired Brown fresh from law school two decades earlier. He'd been impressed by Brown's stint on a nearby city council.

"He did not develop the way we wanted," Jones said this week. "He was average. Maybe that's the best way to put it."

Brown was pleasant enough, if a bit opportunistic, Jones said, but he did not put enough time and energy into his job. "He would have been better suited to be a small city or county lawyer," he said. Jones was surprised Brown was being considered for job at FEMA but figured it wasn't impossible he could have risen high enough in local and state government to be considered for a job directing FEMA operations in Oklahoma.

The agents quickly corrected him. This was a national post in Washington, deputy director of FEMA, the arm of the federal government that prepares for and responds to disasters around the United States.

10. How can the FBI allow this information to be out there and not
stop his appointment? Have they no responsibility in this? If Brownie's past is this bad, what else could be waiting to be discovered about blivet*'s other "political appointees", the 20 that they admitted were in FEMA and others in other organizational charts?

19. Let us keep in mind that demonizing Brown is the political equivalent...
of the "lone gunman" ploy: it focuses our attention on an individual and distracts us from the attitudes, policies and systemic failures that are ultimately to blame for the horrors of New Orleans.

Which is not to minimize Brown's culpability -- merely to caution that we shouldn't allow the oligarchy to turn Brown into a red herring and thereby obscure the need for change.

21. I don't think the focus here is on Browne per se
As I read the postings here, I don't think the focus is on Browne so much as it is on the process the Bush Administration used to select him for his post; it is not just that Browne was incompetent, but that anyone hiring him for such a post knew or should have known that he was unfit for the position.


The same could be said for almost all of the top level personnel in the Bush Administration, including, of course, Bush himself.


That, as I see it, is the central point of this post.

If anyone else knew that his resume/bio was a lie (hence Bush or Cheney) they too could be breaking the law. And one would think if Bush appointed him, he had to have known what his resume stated was false.

Everyone deserves legal representation. It is a constitutional right.

However, the fact remains that those who represent Muslim Fundamentalists are persecuted, in Lynn Stewarts' case, actually prosecuted.

So this should definitely go out and get wide dissemination.
