If you want to debate with people who believe in "strict constructionism" this is where to start.

The bare truth is all these "federalist society" fuckers are a bunch of conservative asshole partisans who read the constitution in the light of what they want (the 19th century). They are NOT literalists. They merely find the bits where there pre-decided philosiphy fits literally with the Consititution and point out where liberals seemingly differ from that "literalism".

It is VERY true that there is no explicit right to privacy in the Constitution. For that matter, there is no explicit right to vote. But the same people who will trumpet this from the heavens will grant corporations all human civil rights based on the 14th amendment (corporations are composed of groups of people, therefore it is reasonable that they have the same rights).

I personally think that lefties and liberals HAVE leaned too heavily on the courts. Instead of leaning on courts to assert the SPIRIT of the Constitution, we should have been leaning on legislatures to make the Constitution more EXPLICIT!!!

The reasoning here is VERY clear. Those who HAVE rights are typically happy and content. There is no need to organize and become political. You organize and politicize when you are disenfranchised and in need of rights.

Conservatives have discovered that creating the mirage of "Christian Persecution" is a great trick to organizing a base into action. And their convenient slight of hand with "activist judges" have given them something they can run against in perpetuity.

By leaning back onto a slightly vague constitution, we fall right into their hands. We are apealing to those "unelected judges" again instead of getting literal. Our response to partial birth abortion bans should NOT be to assert constitutional rights. Our response should be a bill EXPLICITELY laying out the right to civil and personal PRIVACY that would lay the issue to rest for good.

We should be pointing out that THEY the conservatives have packed the courts with their right wing nutcase judges that are ready to take away their rights. We should be pointing out that their picks are ready to strike down minimum wage, child labor, workplace safety, worker compensation and pension protection legislation.

This is NOT hot air. These fuckers really DO want to dismantle the New Deal and all the prosperity that followed in it's wake. Our commercials should feature bread lines and dustbowls. They should feature little girls with their bowels sucked out and the greedy, irresponsible fuckers who did it to her.


We lean to heavily on the rights we are SUPPOSED to have instead of making those rights literal. Every time those right wing blow-hards bring out yet another constitutional amendment making flag burning illegal, we should bring forward an amendment making abortion EXPLICITELY legal!!!!
