Jerry Kilgore's position on abortion (exceptions for rape and incest)
The Republican candidate for Virginia governor says that he would allow abortions in cases of rape and incest only if the woman reported the sexual assault to law enforcement within seven days.

OK, let's say he gets his way: what if the accused person is later found innocent at trial, or there is just not enough evidence to bring him up to trial? Abortion is a time-sensitive matter, and the abortion would have to proceed before many of these legal decisions could be made.

Also, I worry about that kind of policy possibly leading to false accusations against a lot of men of "rape" just so the woman can get a legal abortion. I could see it happening.

1. What if the victim is mentally incapacitated?
I know of an instance where a person who was physically/mentally challenged was raped. She couldn't report it because her communication level was that of about a one year old. They didn't know anything had happened until she showed signs of being pregnant. Her guardians had an abortion performed, but the cops never even bothered to get tissue samples to find out who the rapist was. The police wrote off the whole case as "well, she had a good time".

And of these, how many would wait over a week, out of embarrassment or humilition before reporting to the cops?

Women will be accusing men of rape where that isn't the case.

And in cases of incest, what if it takes longer than 7 days for the kid to contact the authorities? What if the kid isn't aware of the requirements? What if the father or stepfather keeps the kid grounded for 7 days?

If incest is a reason, then am I to assume that there are no parental notification laws?

And if a fetus really is a baby, is it the fault of the fetus that the mother is raped? This is a hypocritical opinion IMO. If the mother's emotional well being is a concern, then she should be the one to decide what reasons will make it too emotionally difficult for her to continue a pregnancy.
