Midnight legislation if Davis is booted?

I heard that if Davis is kicked out the new governor will not take office for at least 30 days. During this time Governor Davis and the Democratic legislature could enact all kinds of midnight legislation, which Schwarzenegger would not be able to overturn. They could also pass legislation that weakens many of the governor's powers, or legislation that makes it easier to recall governors (i.e. Schwarzenegger). Have any of these options been considered?

I think the legislature should've trashed the recall provision before this even began. I wonder if they could pass legislation invalidating the recall. Arnold wins, too bad. We're holding on to the governor's mansion no matter what.

That's a Rove-worthy tactic. There are much better ways of keeping/regaining the Gov's mansion.

We'll just say we aren't going to "stoop to their level" when they orchestrate a coup in California, re-redistrict in Colorado and Texas and steal elections in Florida.

But we'll be able to hold our heads high...from the outside of the councils of power.

I said that there are better ways of holding onto the governor's mansion.

In 2004, when we kick Dubya out of office, he won't leave for like, what 2 or 3 months after the election (I believe inauguration is Feb 7, 2005)? So you think it should be acceptable for Bush to ram through legislation nullifying the election, if he had the ability to do so?

We can keep/regain the governor's mansion in other ways. Recall Arnold. Have him arrested for sexual misconduct/assault. Etc. But to pass legislation nullifying a legal election, no matter how much of a farce it is, will be counterproductive.

6. I read that they need to call a special session for the legislators

To lock in some bills or something before Arnold gets in office - so he can't undo them right away.

Davis is the legally elected governor, he should do everything he can as fast as he can to try to minimize the damage that Rove is going to do to California.
