AUSTIN, Texas -- The next step in the criminal proceedings against Republican leader Tom DeLay is a trip to Austin to be fingerprinted and photographed.

DeLay was indicted Wednesday on one count of criminal conspiracy for his alleged role in a campaign finance scheme that helped give Republicans power in the Texas House and in Congress.

DeLay's attorneys were working out the details of when the 11-term congressman would return to Texas in hopes of saving him from further embarrassment, they said.

"What we're trying to avoid is Ronnie Earle having him taken down in handcuffs, and fingerprinted and photographed. That's uncalled for and I don't think that's going to happen," said Dick DeGuerin, DeLay's attorney.

He waived the statute of limitations on the conspiracy charge under advise and consent of counsel. The only reason for that would be if he was bargaining on a plea and faced more serious charges that did not have a three year statute of limitations.

Here's the text from the indictment:

"The Grand Jury further presents that, with the advise and consent of counsel, the defendent, Thomas Dale DeLay, did heretofore knowingly, intelligently, and voluntarily waive application of Articles 12.01 and 12.02 of the Texas Code of Criminal Procedure to the indictment presented herein. In particular, the Grand Jury present that with the advice and consent of counsel, the defendent, Thomas Dale DeLay, did knowingly, intelligently, and voluntarily waive the requirement that an indictment for the felony offense of criminal conspiracy, the object of which is felony other than those listed in Subdivisions (1) and (5) of Article 12.01 of the Texas Code of Criminal Procedure, may be presented within three years from the date of commission of the offense, and not afterward, insofar as such requirement pertains to the indictment presented herein,"

25. What no one seems to realize is the probability Bush will...
pardon DeLay (no matter what he is convicted of) and then (by gerrymander, Diebold or whatever else is necessary) keep DeLay in office. Same for anybody else so convicted: Nix...er, Bush will simply pardon him. (Or her.)

In fact -- as the indictments roll in -- I think we'll see how defiantly criminal this administration truly is. That's why -- until there's a new Democratic president in the White House -- any celebration is premature.

31. I was under the impression the president could pardon ALL convictions...
including those by state courts (as in Ford's pardon of Nixon, which also granted Nixon blanket immunity from ALL presidential-conduct charges in ANY courts, federal, state or local.)

35. Thank you. Obviously I was wrong.
This also says that much of the reporting on Ford's pardon of Nixon -- that it was a blanket, absolute pardon even for offenses against local law like the Watergate Burglary itself -- was wrong. Part of my love for DU is that it is a place even an opinionated, geezerly curmudgeon like myself can actually learn something. Thanks again.

to pay for the entire Republican party") -- I don't think the Republicans give a damn. I think that is precisely the lesson of New Orleans, especially the brazen fuck-you manner in which Bush is turning the "recovery" into obscene profits for his supporters.

Thus I believe the Republicans will defiantly milk the country dry between now and 2008, monkeywrenching the elections any way they can, hoping to remain in power by whatever means necessary (including even a homeland-security/military coup), but nevertheless prepared to surrender if they are forced to -- and meanwhile reducing America to a Third World horror, all the while knowing that if necessary they can flee to some non-extradition country and live off their offshore investments and Swiss bank accounts. Which is why -- if it takes a state pardon to keep DeLay out of prison -- that is precisely what will happen. Likewise once the Enron trials are over, I have no doubt those people will all be pardoned too.

Stop thinking of the Republicans as ordinary Americans or even ordinary human beings. They are not: they are plutocrats and fascists -- every bit as remorselessly savage as Jihadists in their contempt for the American people, and therefore the personal enemy of every American who is not part of the oligarchy. Beyond the fact that it gives many of the plutocrats pleasure when we suffer and die (note Bush gleefully playing guitar as we died in New Orleans), they are absolutely indifferent to what we think and feel. All that matters to them is profit, whether materially or politically. "If this means infuriating the electorate with a pardon, so be it -- one way or another, the electorate can always be nullified": not a "real" quote, but nevertheless exactly how they think -- and until we realize the full import of that hideous truth and act accordingly, we will continue to lose.
