Despite his well-known penchant for corner-cutting, I'm inclined to give Delay the benefit of the doubt that this is, in fact, a politcally motivated prosecution and all that, though I've still got homework to do.

But man is this a drag. Regardless of the merits, this is going to be long, weedy, partisan argument. Rich's emailer may well be right that there's a big difference between a federal and state indictment. And I’m sure his legal eagle’s point that conspiracy charges like this one tend to be hail Mary passes at best. But this is terrible turf for Republicans to get stuck playing on and tedious for the rest of us. But I’ve already announced my melancholia.

6. I don't know where

these clowns are coming up with the "Conspiracy is a long shot", "conspiracy is a last ditch effort", "Conspiracy is hard to prove" stuff but it is not based on the reality of criminal prosecutions in this country. Conspiracies are preferred by prosecutors precisely because they are very often easier to prove than any particular criminal act, especially when they are going after a "boss" who is less likely to have actually done any of the heavy lifting in the criminal endeavor.

15. This is NOT a "Hail Mary Pass", it's a PLEA BARGAIN

DeLay will plea "nolo contendere" because he "under advise and consent of counsel did knowingly, intelligently, and voluntarily" waive the statute of limitations on the conspiracy charge.

You only do that if you're facing much tougher charges that don't have a statute of limitations or a much higher statute of limitations.

It's all right there in the indictment for eveybody to see:

"The Grand Jury further presents that, with the advise and consent of counsel, the defendent, Thomas Dale DeLay, did heretofore knowingly, intelligently, and voluntarily waive application of Articles 12.01 and 12.02 of the Texas Code of Criminal Procedure to the indictment presented herein. In particular, the Grand Jury present that with the advice and consent of counsel, the defendent, Thomas Dale DeLay, did knowingly, intelligently, and voluntarily waive the requirement that an indictment for the felony offense of criminal conspiracy, the object of which is felony other than those listed in Subdivisions (1) and (5) of Article 12.01 of the Texas Code of Criminal Procedure, may be presented within three years from the date of commission of the offense, and not afterward, insofar as such requirement pertains to the indictment presented herein,"
