Failure to do so could result in impeachment.

The standard is not impropriety.

That would make it 6 justices who would have to recuse themselves.

Scalia and Thomas should have recused themselves in 2000. Their decision begat Roberts and now, possibly Miers and I don't expect any better from those two. That's not how rightwingers do things.

5. Agreed but this is a minor issue.
One way or another, bush will be gone by 2008. I'm more interested in the next 20 years or so of Judaical decisions that will result from this appointment. I don't think that we should decide how we feel on this nomination based solely on her relationship with the idiot. The question is, if not her then who? Do we think that there is even the remotest possibility that we will get someone acceptable to the majority of DUers? I don't think so. I am encouraged by the anger of the hard core right and her support of Democrats and pro-choice candidates in the past.

recuse themelves....WStarr are you still sucking on your pacifier? The bush trick is to place this inexperience person to steal the media story and take the heat off the administration. If the democrats fight over this fool of a woman, the story will be centered against the democrats. I say, quickly confirm the idiot and move on to the real problems facing this nation before 2006 gets here. Use all these inexperience people appointed by little bush against them all.
