They have information that he purchased (not sure if taped phone calls are admissable in court in Florida) but he was not caught in posession of anything. It's going to be tricky to see if they can charge him or how.

for criminal possession, unless there's some quirk in FL criminal law that sets it apart from the rest of the U.S. Generally, IIRC, the elements are possession and intent to possess. The former of the two elements can be established without showing that the defendant was caught by the police possessing the drugs. For example, the testimony of the maid could clearly establishes the element of possession.

Lighten up pal. I wasn't talking about the law. I said that unless they caught him red-handed with the drugs, the were not going to charge him. I didn't say they didn't have the right to charge him . . . just that they wouldn't. It was an opinion. I'm a CPA not a lawyer. But I wouldn't want to prosecute a case where my star witness was a drug dealer. Not that a case couldn't be made, but Rush's lawyers would tear her character apart. PLUS, it is crystal clear that she is out trying to make money on this story. I don't think they will prosecute based on her testimony and some inadmissable tapes.

That's why I'm pissed. Had she worked with the authorities longer, instead of running to the Enquirer, they could have set up a sting and nailed his ass.
