might have been helpful in your original post. This Frist "poll" is on a subject of utmost importance to our future and we HAVE to win this showdown or be stripped of our rights by Scalia/Thomas/Rehnquist clones apponted to lifetime positions on the federal benches.
Once the federal benches are packed with a bunch of right wing Federalist Society goons, it won't matter who occupies the executive branch or has the majority in congress. The present GOP ideology will control everything from the bench and dominate our future. They won't have to be in elected office to beat on us for the next 40 years. They'll do it from the bench.
The fight over federal judges is a fight for the future and it is of utmost importance to win this one NOW!
Frist's poll question itself is a lie. There is NO specification in the Constitution that mandates an up or down floor vote on judicial appointments. The Senate is to give advice on judicial appointments and it is free to consent to them or not. There is no prescribed method such as an up or down floor vote by which the advising and consenting process must be carried out. The Senate Democrats (enough of them to hold the line anyway) have made it clear that they DO NOT CONSENT to some of Bush's appointments and they have been filibustering some (they'd add more if they had more support from us) for months. They have confounded the Senate GOP leadership with their adamant non-consent, and blocked the most odious to this point.
The Senate Democrats have been fighting a valiant battle on our behalf on this matter from day one of the Bush installation, sadly, with very little support from DU and little mention of their beleaguerment by any of our candidates who are now getting media time due to the election cycle.
Frist is staging a 30 hour all nighter spectacle on the Senate floor to try to fool the masses into taking action into pounding the Democrats into submission. Don't fall for this "up or down vote bs." It's not in the Constitution nor should it be. Obviously, if there were an "up or down" vote ALL Bush* appontments would be a shoe-in.
Our elected representatives have a right to block the nominations by filibuster and thus block a floor vote. Bush* or rather Gonzalez, the guy in the admin who really picks these nominees, can just go back to the drawing board and send up the names of more moderate nominees or leave the seats vacant. It's that simple.
This is urgently important folks. During this 30 hour beat-up on the Democrats time staged by Frist we simply MUST let our guys know that we support them in their filibuster or it's all over. I suggest we start sending them notes of support and perhaps tangible items, like flowers or something, that Frist and Hatch will see being delivered. At the least we should all vote NO on his Frist's little poll.
