Is it property of the person who took it, the WH, or is it public domain to use on a t-shirt or something of the sort?

on who you are. If you are a Repug and use photo to further glorify Shrub....it would certainly be public domain and you would be considered a hero.
however, if you are a Democrat and use the photo to discredit the Shrub, you would be accused of treason and shot at dawn.
