Unemployment Insurance overpayment. Serious Q? need help.
Disclaimer: The person I am talking about is NOT me.

Joe lost his job of 26 years (Reduction in Forces). He filed for unemployment and began to collect. He got his stuff together and moved to the adjoining state. Eventually he got a job at less than half the pay he had previously earned. He continued to file for unemployment from State A while living in State B (I know, I know). After about 4 months Joe quit his job due to lack of training and harrassment. He collected unemployment until the fund was depleted. He remains unemployed. Now state A wants an explanation for the money he earned at the new job and a reason why he quit. State A knows what Joe was paid each week he worked in State B even though Joe did not claim the income on his tax return (I know, I know). The employer in State B never sent Joe a W-2 by the way. Q: Can state A collect from Joe while he is living in State B and how? What happens if he blows them off? Anyone know how this stuff works? I have never collected unemployment and am clueless. This is serious and any input would be greatly appreciated. Thanks.

But I'm damn sure I would have the number of my legal aid society handy.Espically if it involves the Tax folks.I can see at least 3 felonys.

There is a federal component to Unemployment and so there are federal statutes and possible crimes involved in this. It should be obvious to him that the fact that they found him out despite being employed in another state that there is reporting and information sharing up the line and across the states.

AT the least, he should be prepared to return the money he obtained from State A under false pretenses (that might not be ALL the money). That might make them less inclined to pursue him legally.

5. As a retired UNION construction worker
I can tell you that "Joe" has probably lost his right to future benefits until he 1: pays back all the ill-gained $$$ 2: serves a penalty period (up to 3 years) in which he can draw no benefits... Atleast that is roughly how it works in Culleeforneeya. The system is very biased against the worker. I was once charged with "making a false statement". When I proved that my ex-employer was the actual false statement maker, the UI dept told me that there was no way to prosecute an employer that made a "false statement".
