Question: would you tell?
heres a situation.

background: im a law school graduate. i sit for the bar in 11 days. one of the briefs i wrote in school regarded the fair housing laws.

ok im trying to find an apartment for my best friend, male. were tearing through the newspapers for something cheap. we find a place that rents weekly, covers all utilities. 190 a week + 400 up front. its in a older house, oddly constructed. its small. cant swing a cat in there.

the landlady is talking to us, explaining how she was eager to have someone move in, and many people asked. my friend was first to repsond to the ad. ok. she then slips in "i refuse to rent to single women" and then says its cause they fight with boyfriends, are all experimental and so on.

thats pretty much de facto housing discrimination. mike wouldnt have standing to sue, but should i notify the DOJ (who would handle such a thing) to possibly investigate? its a small house, with maybe 5-6 tenants, and was completely full.

just curious. i didnt say anything to her but commented to my friend that she was in violation of federal law is she indeed didnt rent to single women.

Does she also live in the house? That makes a difference.
It is then considered a quasi roommate. I believe this even applies if you live in a seperate but attached townhouse with up to 4 units.

2. Yes
A nice letter from the State Authorities might prompt her to readjust her thought process.

5. You have the bar in 11 days?
What are you doing in the DU Lounge?!?!? Back to studying!!!

j/k What state are you sitting for? I have California and Montana, and, as long as I live, I will never sit for another bar exam.

:puke:

Good luck -

KJ

6. Are you sure about that?
"Section 3605. Discrimination in residential real estate-related transactions

(a) In general
It shall be unlawful for any person or other entity whose
business includes engaging in residential real estate-related
transactions to discriminate against any person in making available
such a transaction, or in the terms or conditions of such a
transaction, because of race, color, religion, sex, handicap,
familial status, or national origin.
(b) ''Residential real estate-related transaction'' defined
As used in this section, the term ''residential real
estate-related transaction'' means any of the following:
(1) The making or purchasing of loans or providing other
financial assistance -
(A) for purchasing, constructing, improving, repairing, or
maintaining a dwelling; or
(B) secured by residential real estate.
(2) The selling, brokering, or appraising of residential real
property.
(c) Appraisal exemption
Nothing in this subchapter prohibits a person engaged in the
business of furnishing appraisals of real property to take into
consideration factors other than race, color, religion, national
origin, sex, handicap, or familial status."

It is my understanding that "familial status" has been narrowly interpreted to mean "with or without children."

Your input is greatly appreciated.

Thanks,

Floog
