Should your drivers license be suspended if your insurance agent insures
the wrong car?

Seriously. The agent heard the right information and insured a car already insured by another company. And I didn't realize it because I didn't check the card or the policy as it was a renewal. And yes, he canceled the policy on the original vehicle. And the agent is lying now, saying I was the one who was mixed up. (NO chance I would pay two premiums to two companies for the same vehicle.)

My question to you: Have you heard of insurance agents messing up like this?

I'm going to the DMV to persuade them at my hearing to un-suspend my license.

If you can show you were actively paying for insurance, there's a chance for you...otherwise, friend, you are probably shit outta luck!

Used to happen to me all the time, when I was a kid.

My brother would fuck up...and, since he was "good kid" and I was "bad kid," anytime ANYTHING was fucked up, it was always MY FAULT...unless I could PROVE otherwise.

And I cannot tell you how many times that bastard KNEW GODDAM WELL he was the one who fucked up...and LET me take his punishment, the effing bastard!!

It DOES suck to get punished for something someone else did...believe me, I know from personal experience.

The insurance company even carries special coverage to pay for their mistakes. I think you might need to talk to an attorney though. Since you were paying two premiums to two companies for the same vehicle, you have evidence that you were either cheated by the agent or the agent made a mistake. Did you report this incident to your state insurance commissioner? The agent or agency probably owes you money. I would contact the state insurance comission first and then if I didn't get satisfaction I would get an attorney. But if your state insurance commission is any good for consumers -- ours can be quite helpful in Louisiana -- then you'll probably get this problem corrected without need for filing a lawsuit.

Your state law requiring insurance is not contingent upon the element of "intent." It does not say that you shall carry insurance "unless you or your agent make a mistake."

IMHO.

Then it very obviously IS a screwup, he WAS carrying insurance, or, at least, HE was meeting his obligations and responsibilities as a driver...and if the documentation shows this, I think he has a pretty good shot. Not that I'm a lawyer, but, christ...are they gonna punish someone because some dumb-assed data entry clerk transposed two numbers or some shit like that??

If he can show he was making regular, constant payments for insurance, there should not be a problem.

Then again, if he CAN'T document this, then, yes, he probably is fucked.

No more innocent till proven guilty in this country! You gotta prove your innocence. In this case, I think the guy CAN.

10. If I understand correctly
I think the key is that she was not making payments on an insurance policy covering the car in question. There simply was no insurance coverage on that car.

It would be really great if no_hyprocisy could get a lenient and forgiving prosecutor or judge, but those types are rare.
