A 61-year-old grandmother who jaywalked after a Tucson Sidewinders baseball game - which led to her to be taken down, handcuffed and arrested by sheriff's deputies - was found guilty Tuesday of two misdemeanors.
Penni Wilson-Neely, 61, said she was exhausted after an evening at the ballpark with her 2-year-old grandson and was walking across a road when she was grabbed by a man who hadn't identified himself.
She elbowed him in the chest, then found herself being taken to the ground and arrested.
Prosecutor Sharon Briggs said Deputy Jason Dowdy was trying to move Wilson-Neely out of the path of a sport utility vehicle as Dowdy directed traffic outside Tucson Electric Park on July 4, 2004. Dowdy said he tried to take her down as gently as possible once he was elbowed.
Justice Court Judge Frank Moore acquitted Wilson-Neely of assaulting Dowdy but found her guilty of obstructing government operations and of resisting arrest.
She paid $600 in fines but will not face jail time, despite Briggs' request that Wilson-Neely serve two days in jail.
The incident began at about 9:45 p.m., as fans left Tucson Electric Park after a baseball game and fireworks show.
Wilson-Neely, a San Diego resident who was in town to visit family members, said she drank nothing at the ballpark other than bottled water. She approached a road where Dowdy was directing traffic.
