Until the RIAA can prove that those artists mix CDs are in fact infringing property.... weren't they basically shoplifting?

2. Buy vinyl at garage sales.
Rip the LP's as WAV files (to get the best quality) and copy those to CD-R's for posterity. The RIAA can't touch you because you own the original media and that's FAIR USE. I have several myself, and they sound better than most of what you find on KaZaA.

If you must buy CD's, buy them from second-hand vendors at Amazon or Half.com. You can get just about any disc for about half retail. Most classic rock stuff goes for less than $5/disk.

6. Burning cdr from vinyl disks.
I hope you are correct about this being fair use.

I keep up on copyright law pretty well and I don't think this is a settled legal issue.

There are strong arguments that this archival copying should be considered fair use, but as far as I know, the issue has not been decided by the courts.

I believe that dedicated cd burning machines that burn only audio CDs on special disks are subject to some sort of prepaid licensing fees, levied in connection with the blank disks. If this is true, it is some indication that archiving on CD might possibly not be fair use.

The RIAA is probably unlikely to start getting search warrants to ferret out this archiving behavior anytime soon. However, that enforcement issue probably doesn't have too much to do whether the copying of a vinyl disk into WAV format is ultimately infringement not covered by fair use.

If anyone knows of a recent case regarding archiving of vinyl disks, pls let me know.

7. I doubt it's occured yet
it's not like they can bust down people's doors to randomly search if they have CD-Rs of their vinyls.

5. The loss of Indie record stores is devastating...
How freaking sad that the RIAA is trying to close up the Indie record stores...what they don't seem to understand is those are the stores where next year's big acts first appear (i.e. You don't think Best Buy broke "The White Stripes" do you???).

I used to work for a GREAT indie store in the DC area back 12-13 years back (called "Vinyl Ink")...the amount of audio art I got to turn people onto was amazing...the big chains can't offer the kind of personal service (and just plain fandom!!!) of people in an indie record store...

Anyways, this really bummed me out :(
