7. I'd agree on 1 & 2. My third would be Plessy v Ferguson.

Or, perhaps, Santa Clara County v Southern Pacific RR, which established the doctrine that corporations are persons under law. Both had repercussions which have affected America for over a century, and are still; Bush v Gore may yet prove inconsiderable in comparison. God knows there was political knavery (Hayes - Tilden, anyone?) and warmongering (Mexico? Cuba?) enough before Bush came along.

And in response to the original post, re: who would I nominate? Cuomo would be good, but I think I'd rather see O'Connor's seat filled by a qualified female jurist who's at least centre-left if not liberal politically. (Unfortunately, I can't think of any offhand that I'm familiar with.)

8. I did think of Plessy

I hesitated it because of Justice Harlan's dissent. Belongs on the list, though (as we know, dissent isn't that relevant, but can presage changes in the law).

on 1 and 2. Those have got to be the 3 worst SC decisions.

As for 3...my list for who should never be a SC Justice is so much bigger than who should be. Starting with my asshole of a former Con Law professor. But I digress. Actually, I think my former Advanced Con Law/Federalism professor would be quite good. She's a moderate in the good sense. Meaning she would actually uphold the constitution, but could also get through the nomination process in a split Congress.

I'd nominate any one of three profs I studied Constitutional Law with: Richard Fallon, Laurence Tribe or Steven Shiffrin. Fine liberals all, and damned nice people to boot.
