I fiddled with the Wal-Mart logo last week...



and right after I put this in an image 'placeholder' on Cafe Press, I got an e-mail detailing that policy. I've since removed the image from Cafe Press.

4. Actually, I thought that was fair use of trademarks...

to mock the company in question. BTW: Separate from copyrights, look at the circled "R", that's a registered trademark. Probably remove that from the image, and it should be perfectly legal.

8. Legal, yes -- OK with CP, no

Everywhere else, this kind of parody is protected as free speech -- but CP is VERY paranoid about brand names, company logos, movie/TV merchandise, sports teams (even regardless, CP says, whether or not it's for legitimate fan-club purposes)... There's a long, long list of stuff you can't do.

Like DU, CP is not a democracy. Not that there's anything wrong with that. ;)

CP felt my bright red box of "Failure Fries" looked far too much like it came from McDonald's, so they canned it before I ever got it out of the image basket.

I don't mean to hijack this thread, but as long as we're on the subject of CP's CUP (Content Usage Policy)...

Here's an interesting thing: I have a handful of new Pat Robertson stickers up. CP red-flagged one that said "Pat Robertson is a Radical Militant Cleric" -- but did NOT pull the one right next to it that says "Pat Robertson is a Terrorist" (nor my "campaign" buttons, "Pat Robertson for Ayatollah").

Rather than challenge CP on it (I don't want to make waves over there), I scanned the message boards re the CUP and came away with the impression that:

1. Politicians are fair game; other celebrities are not.

2. Arnold Schwarzenegger is fair game because he's a politician, BUT...

3. You can't refer to Ah-nold's movie career, because then you're using him as just a celebrity, and not a politician.

I came to the conclusion that I can call Pat Robertson (who, as a failed presidential candidate, is still a politician) anything I want... as long as I don't refer to his career as a preacher!

So, I could probably make another that says "Pat Robertson is a Radical Militant" (sans "Cleric") and it would be OK. (I won't, since it doesn't have the impact I want.)

Talk about splitting hairs... but I guess they've got to draw the line somewhere. And CP is very cool about what we put on our stuff -- they're just (understandably) worried about lawsuits.
