Anyone know how to get a death certificate in Nebraska?
I've already been to the state official records site, and I'm not sure we qualify.

My uncle died in 2003, and my great-grandfather didn't have the ability to change his will after my uncle died. So now we're trying to probate out the will, and we need a death certificate for my uncle so that probate can continue. (The will reads that if any of the heirs pre-decease my great-grandfather, all of the assets are redistributed equally among the living, and the heirs of those who pre-decease my great-grandfather are SOL.)

My uncle's widow refuses to get a death certificate for my grandmother (they have a long and unfixable feud).

My uncle's widow will get something once the estate is through probate, but she thinks if she holds out, she might get my uncle's share (which is not what my great-grandfather wanted, and that is specifically in the will as not to happen). My grandmother needs to get the debts paid off before we lose the estate entirely to property tax auction.

Any idea how to get a death certificate if you're not the child, parent or legal representative of the deceased? Can siblings count as next of kin?

2. I'll call the family lawyer tomorrow.
It's just that my grandmother and mother think that because my great-grandfather paid for my uncle's funeral (my uncle was a minister, and they have a pretty bad pension plan) the estate should be able to get the death certificate.

I hate to tell them that it doesn't work that way because they both have a tendency to shoot the messenger and I'm not even IN Nebraska.

6. No. Don't do that yet. Get a copy of your grandmother's...
drivers license, or other form of ID, and mail it with the application here http://www.hhs.state.ne.us/ced/death.pdf to the address on the bottom of the application.

At least try this before bringing a lawyer into it. I don't think you'll have any trouble at all!

3. You may wish to cross post this in the Nebraska forum.

4. You've probably already
been to this site, but just in case...

http://www.hhs.state.ne.us/ced/decert.htm

and you can poke around here to see if the Nebraska statutes define "next of kin"
http://srvwww.unicam.state.ne.us/Statutes2005.html

Hope that helps.

8. Thanks... Been there.
It's not real clear if we are eligible. But I suppose that for seven bucks and the price of a copy of a driver's license, a stamp and an envelope, it's not too expensive to try.

5. Your grandmother can request the death certificate, according to...
Nebraska's Vital Records website.

Anyone in the immediate family, including the mother of the deceased, can get a certified copy of the death certificate.

Read this: http://www.sos.state.ne.us/business/regsearch/Rules/Health_and_Human_Services_System/Title-174/Chapter-3.pdf

Then go here to get the certified copy, which will cost $7:

7. My grandmother is my uncle's sister, not his mother.
Sorry, I guess that makes him a great-uncle, doesn't it?

She's the only one left in the family of that or an older generation, though.

And it looks like she can file for it under section 004.02A

Thanks. I read that, but I guess it didn't sink in very well.

I'll call her tomorrow and make her go mail the application.
